AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 29, "WATER AND
SEWERS", OF THE CODE OF ORDINANCES OF THE CITY OF
DELRAY BEACH, FLORIDA, BY AMENDING ARTICLE II, "WATER
SERVICE", SECTION 29-17, "USE OF WATER FROM HYDRANTS",
TO PROVIDE THAT A UTILITY BILLING DIVISION EMPLOYEE
UNDER THE DIRECTION OF THE UTILITY BILLING/CUSTOMER
SERVICE SUPERVISOR MAY CONSENT TO THE USE OF FIRE
HYDRANTS, THAT A MINIMUM DEPOSIT OF TWO HUNDRED
DOLLARS SHALL BE REQUIRED FOR THE USE OF SUCH FIRE
HYDRANT, THAT A MINIMUM DAILY CHARGE OF EIGHT DOLLARS
FOR INSIDE CITY USE AND TEN DOLLARS FOR OUTSIDE CITY
USE SHALL BE REQUIRED, AND THAT SHOULD THE AMOUNT OF
WATER TO BE USED BE PREDETERMINED TO EXCEED THE
MINIMUM DAILY CHARGE, THE UTILITY BILLING/CUSTOMER
SERVICE SUPERVISOR MAY REQUIRE THE USER TO APPLY FOR A
WATER METER; PROVIDING A SAVING CLAUSE; PROVIDING AN
EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Section 29-17, "Use of water from hydrants", of the Code of
Ordinances of the City of Delray Beach, Florida, be and the same is hereby amended to
read as follows:
Sec. 29-17. Use of water from hydrants.
Fire hydrants shall not be used for obtaining water under any circumstances,
except by consent from the fire chief, and under his regulation and control, or some
employee of the ~a~ter-xl~par~efl~ Utili.ty Billing Division, under the direction of the
ehief--o~-t½e-{i,~-depa~[~ Utility Billing/Customer Service Supervisor. In case fire
hydrants are used on a temporary basis for obtaining Water, a ~our-~red-do~l~r
d~t minimum deposit of two hundred dollars ($200.00) shall be required,

length of time the fire hydrant use is needed.

eome~med~ The minimum daily charge for water from such hydrants shall be
doll~l-s--(-$~.-4)~) eight dollars ($8.00) for inside city use, and ten dollars ($10.00) for
outside city use. In the event that the amount of water to be used is predetermined to
exceed the minimum dally charge, the Utility Billing/Customer Se~'vlce Supervisor may
require the user to apply for a water meter.
Section 2. That should any section or provision of this ordinance or any
portion thereof, any paragraph, sentence, or word be declared by a court of competent
jurisdiction to be invalid, such decision shall not affect the validity of the remainder
hereof as a whole or part thereof other than the part declared to be invalid.
Section 3. That this ordinance shall become effective ten (10) days after its
passage on second and final reading.
