74-85 ORDINANCE NO. 74-85 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 30, "ZONING", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMEND- ~ ING SECTION 30-18, "OFF-STREET PARKING REGULATIONS", SUBSECTION (BX4Xg), "OFF-SITE PARKING"(2), TO PROVIDE THAT CONDITIONAL USE APPROVAL SHALL NOT BE REQUIRED WHERE PARKING IS PROPOSED TO BE LOCATED OFF-SITE IN AN RM-10, RH, OR RM-15 ZONING DISTRICT ON A NON-RESIDENTIAL, CURRENTLY EXISTING, CONDITIONALLY AP- PROVED OR PERMITTED PARKING AREA PURSUANT TO A VARIANCE; PROVIDING A REPEALER CLAUSE; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELI~.AY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 30-18, "Off-street parking regulations", Subsection (B)(4)(g), "Off- site parking"(2), of the Code of Ordinances of the City of Delray Beach, Florida, be, and the same is hereby amended to read as follows: (2) Within the GC General Commercial, SC Specialized Commercial, CBD Central Business District, and LC Limited Commercial zoning districts, all or part of the off-street parking spaces may be located on an off-site parking area Which has an RM-10, RH, or RM-15 Multiple Family Dwelling District classification, provided said parking area is adjacent to, and abuts the lot or parcel of land on which the principal use or building is located. If the alternate site is proposed to be located in the RM-10, RH, or RM-15 zoning districts, such site shall be subject to conditional use approval (Sec. 30-21)~ However~ if the parking is located on a non-residential~ currently existing, conditionally approved or permitted parking area pursuant to a variance~ then conditional use approval will not be rec]uired. Such parking shall also be subject to m~6the conditions of subparagraph (3) below. A means of pedestrian access from the off-site parking area to the principal building or use shall be provided. Parking for both employees and customers may be provided under this sub-paragraph (2). Section 2. That all ordinances or parts of ordinances which are in conflict herewith are hereby repealed. Section 3. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 4. That this ordinance shall become effective ten (10) days after its passage on second and final reading. pASSED AND ADOPTED in regular session on second and final reading on this the 13th day of August ,1985.
