90-85 ORDINANCE NO. 90-85 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH', FLORIDA, CHANGING THE CITY'S LAND USE PLAN DESIG- NAT ION IN THE COMPREHENSIVE PLAN FOR PARCELS OF LAND LYING AND BEING IN SECTION 9, TOWNSHIP 46 SOUTH', RANGE 43 EAST, FROM MF-10 MULTIPLE FAMILY TO C-COMMERCIAL; AMEND- ING THE LAND USE PLAN; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH', FLORIDA, AS FOLLOWS: Section 1. That the legal description of the subject property is as follows: The Southerly 95.11 feet of the North 324.1 feet of the Easterly 121.08 feet of Lot 38, lying West of the Intracoastal Waterway in Section 9, Township 46 South, Range 43 East, as shown in Official Records Book 963, Page 32, of the Public Records of Palm Beach County, Florida, a/k/a 1925 North Federal Highway, Delray Beach, Florida. AND A part of Lot 38 of the Model Land Company Subdivisions of Sec- tion 9, Township 46 South, Range 43 East, Palm Beach County, Florida. Beginning at a point of intersection of the South line of Lot 38, Model Land Company Subdivision of Section 9, Township 46 South, Range 43 East, with the Westerly line of the Intracoastal Water- way, said point being also the Northeast corner of Lot A, of the Subdivision of Snow Hill; thence run in a Westerly direction along the common boundary line between the said Lot 38 and Snow Hill Subdivision, a distance of 121.08 feet; thence run in a Northerly direction parallel to the westerly line of the Intra- coastal Waterway with an angle of 82°19'50" measured from East to North, from the South boundary line of the said Lot 38, a dis- tance of 95.11 feet; thence run in an easterly direction, along a line at right angles to the preceding course, a distance of 120.0 feet to a point in the Westerly line of the Intracoastal Water- way; thence run in a Southerly direction along the Westerly line of the Intracoastal Waterway, at right angles to the preceding course, a distance of 78.95 feet to the point of beginning, and A non-exclusive easement for ingress to and egress from the above described property over the following described property, to-wit: Beginning at a point on the South line of Lot 38, Model Land Company Subdivision of Section 9, Township 46 South, Range 43 East, which point is 251 feet West of the West right-of-way line of the Florida Intracoastal Waterway; thence run East along said South line of said Lot 38 a distance of 129.92 feet to a point; thence run Northerly parallel to the West right-of-way line of the Florida Intracoastal Waterway a distance of 95.11 feet to a point; thence run Westerly at right angles to the preceding course a distance of 20 feet to a point; thence run Southerly parallel to the West right-of-way line of the Florida Intra- coastal Waterway to a point which is 20 feet North of the South line of said Lot 38; thence run West parallel to the South line of said Lot 38 a distance of 109.92 feet to a point; thence run Southerly to the point of Beginning. The subject property is located on the east sid~'of U.S. HTghway No. 1, between Allen Avenue and Ave. Au Soleil. The subject property contains a 9.82 acre parcel of land, more or less. Section 2. That the Land Use Plan designation of the subject property in the Comprehensive Plan adopted by Ordinance No. 65-79 is hereby changed to C-Commercial. Section 3. That the Planning Director of said City shall, upon the effective date of this ordinance, change the Land Use Plan of Delray Beach, Florida, to conform with the provisions hereof. Section 4.
