96-85 ORDINANCE NO. 96-85 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ANNEXING TO THF CITY CERTAIN PARCEL OF PROPERTY; PROVIDING A LEGAL DESCRIPTION OF THE PROPERTY PROPOSED TO BE ANNEXED; REDEFINING THE BOUNDARIES OF SAID CITY TO INCLUDE SAID LAND; CALLING FOR A REFERENDUM ELECTION IN THE CITY AND WITHIN THE AREA PROPOSED TO BE ANNEXED; DESIGNATING THIS PROPERTY AS "SECTION 1" FOR PURPOSES OF THE REFERENDUM ELECTION; DIRECTING THE CITY CLERK TO PUBLISH NOTICE OF THE REFERENDUM; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: ~. That the City Council of the City of Delray Beach, Palm Beach County, Florida, hereby annexes to the City a compact contiguous parcel of land which is generally described in Exhibit "A" which is attached hereto and made a part hereof. That a more particular description by metes and bounds shall be provided in the notice required under Section 5 of this ordinance and shall be available at the office of the City Clerk four (4) weeks prior to the referendum. ~~_~. That the Boundaries of the City of Delray Beach, Florida, are hereby redefined to include the above-described land and said land is hereby declared to be within the corporate limits of the City of Delray Beach, Florida. ~_~. That a referendum election shall be held on November 5, 1985 within the City and within the area proposed to be annexed to determine whether this annexation is approved both by a majority of those voting in the City and in the area proposed to be annexed. This annexation shall be effective only if approved by a majority of the electors of the City and of the area proposed to be annexed who vote in the referendum election. ~g_~~. That this parcel of land shall be designated "Section 1" for purposes of identification during the referendum in order to facilitate the voters' ability to identify and distinguish among the parcels proposed for annexation. ~f~. That the City Clerk is hereby directed to publish a notice of the referendum election at least once a week for four (4) consecutive weeks i~ediately preceding the date of the refer- endum in a newspaper of general circulation. ~~_~. That if any word, phrase, clause, sentence or part of this ordinance shall be declared illegal by a court of competent jurisdiction, such record of illegality shall in no way affect the remaining portion. ~~1_~. That this ordinance shall become effective on January 1, 1986 provided that the annexation is approved at the referendum by a separate majority of those voting in the City and those voting in the area proposed to be annexed. Se~ %0, 1985 Second Reading September 24. 1985 EXHIBIT A LEGAL DESCRIPTION Beginning at the southeast corner of Lot D of Snow Hill Sub- division (Plat Book'21, Page 83 Palm Beach County) go westerly along the south boundary of said Snow Hill Subdivision to the east right-of-way of State Road No. 5; then go northerly along the east southwest corner of Lot 5, Block A of Snow Rill Sub- division, thence east along the south lot line of Lot 5 a distance of 121.31' thence north a distance of 142.03' thence west a distance of 100' to the east right-of way of State Road No. 5; thence go northerly along the east right-of-way of State Road No. 5 to the northwest corner of Lot 33, Delray Beach Estates, Block 21, Page 13; thence go easterly along the north boundary of Lot 33 Delray Beach Estates to the plat limit, thence southerly along the east boundary line of Delray Beach Estates to the southwest corner of MSA 641A (DB 644, PS 42), thence easterly along the south boundary of MSA 641A to west right-of-way of the Intracoastal Waterway; thence go southward along said Intracoastal Waterway right-of-way to %he point of beginning, excluding Lot 39 of Delray Beach Estates (BK21 - page 13); and including Lots 1, 2, 3, 4, 5, 11 through 19, 20 through 34 and the east approximately (200) feet of Lot 9 Delray Beach Estates, as recorded in Plat Book 21, Page 13, Records of Palm Beach County, Florida along with Lots 6-15 of Block A and Lots 8-15 of Block B of Royal Palm Gardens Subdivision, Plat No. 3 as recorded in Plat Book 21, Page 57 of Palm Beach County records, and including that parcel of land bounded on the west by State Road No. 5, on the north by Royal Palm Boulevard, on the east by Lot 8, Block B of Royal Palm Gardens, Plat No. 3 and on the south by the Eastview Subdivision.
