AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, ANNEXING TO THE CITY OF DELRAY BEACH' LOTS
7 THROUGH' 13, INCLUSIVE, AND THE NORTH' SEVEN (7) FEET OF
LOT 14, BLOCK 3; LOTS 1 THROUGH 9, INCLUSIVE, AND LOTS 16
THROUGH 30, INCLUSIVE, TOGETHER WITH' THE SOUTh' 80 FEET OF
LOTS 10 THROUGH' 15, INCLUSIVE, BLOCK 4; LOTS 1 THROUGH'
14, INCLUSIVE, BLOCK 7, ALL AS SHOWN ON THE PLAT OF WEST
EL BE RECORDED IN PLAT BOOK 15, PAGE 22, PALM BEACH'
COUNTY PUBLIC RECORDS, WHICH LAND IS CONTIGUOUS TO EXIST-
ING MUNICIPAL LI~IITS OF SAID CITY, SAID LAND IS LOCATED
SOUTH' OF LINTON BOULEVARD, BETWEEN THE F.E.C. RAILROAD
TRACKS AND S.E. 4TH AVENUE; REDEFINING THE BOUNDARIES OF
SAID CITY TO INCLUDE SAID LAND; PROVIDING FOR THE RIGHTS
AND OBLIGATIONS OF SAID LAND; PROVIDING FOR THE ZONING
THEREOF; PROVIDING AN EFFECTIVE DATE.
WHEREAS, I.R.E. Real Estate Fund, Ltd., - Series 24, a Florida
Limited Partnership, is the fee-simple owner of the property hereinafter
described; and,
WHEREAS, Robert D. Chapin, as agent for I.R.Eo Real Estate Fund
Ltd., - Series 24, a Florida Limited Partnership, has requested by his
petition to have the property annexed into the municipal limits of the
City of Delray Beach; and,
WHEREAS, the designation of a zoning classification is part of
the annexation proceeding, the City Council has determined that the pro-
cedures set forth in Section 30-23 of the Zoning Code, which applies to
property already in the City limits, shall not be applicable in annexation
proceedings; and,
WHEREAS, the City of Delray Beach has heretofore been authorized
to annex lands in accordance with Section 171.044 of the Florida Statutes,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the City Council of the City of Delray Beach,
Palm Beach County, Florida, hereby annexes to said City the following
described land located in Palm Beach County, Florida, which lies contigu-
ous to said City to-wit:
Begin at the Northeast corner of Lot 7, Block 3, as shown
on the Plat of WEST EL BE recorded in Plat Book 15, Page
22, Palm Beach County Public Records, thence Southerly
along the East line of said Block 3, a distance of 357.07
feet more or less, to a point in a line 7 feet South of
the North line of Lot 14, Block 3, WEST EL BE, afore-
mentioned; thence Westerly, parallel to the North line of
said Lot 14 a distance of 129.86 feet, more or less, to a
point in the centerline of Swinton Avenue as shown on the
said plat of WEST EL BE; thence Southerly along said
centerline a distance of 0.73 feet, more or less, to a
point in the Easterly extension of the East-West center-
line of Block 7, as sho~n on the aforesaid plat, thence
Westerly along said line a distance of 739.94 feet, more
or less, to a point in the West line of said Block 7;
thence Northerly along said West line and its Northerly
extension a distance of 417.09 feet, more or less, to a
point in the centerline of Ridge Street, as shown on said
plat of WEST EL BE; thence Easterly along said centerline
a distance of 820.74 feet, more or less, to a point :n
the aforementioned centerline of Swinton Avenue, thence
Southerly, along said centerline a distance of 62.97
feet, more or less, to a point in the We.~terly extension
of North line of Lot 7, Block 3, aforementioned, thence
Easterly along said line a distance of 129.86 feet to the
Point of Beginning.
LESS the following described property:
Beginning at the intersection of the centerlines of Ridge
Street and Swinton Avenue as shown on the Plat of WEST EL
BE, recorded in Plat Book 15, Page 22, Palm Beach County
Public Records, thence Westerly along the said centerline
of Ridge Street a distance of 371.31 feet, more or less,
to the Northerly extension of the West line of Lot 10,
Block 4, as shown on said plat of WEST EL BE; thence
Southerly along said line a distance of 62.42 feet to a
point in the Westerly Extension of the North line of Lot
7, Block 3, WEST EL BE, aforementioned, thence Easterly
along said 'line a distance of 359.22 feet, more or less,
to a point in the aforedescribed centerline of Swinton
Avenue; thence Northerly along said centerline a distance
of 62.97 feet to the Point of Beginning.
The subject property is located south of Linton Boulevard
between the F.E.C. Railroad Tracks and S.E. 4th Avenue.
The above-described parcel contains a 5.0 acre parcel of
land, more or less.
Section 2. That the Boundaries of the City of Delray Beach,
Florida, are hereby redefined to include therein the above-described tract
of land and said land is hereby declared to be within the corporate limits
of the City of Delray Beach, Florida.
Section 3. That Section 30-23 of the Zoning Code shall not apply
to the establishment of a zoning classification in this ordinance.
Section 4. That the tract of land hereinabove described is
hereby declared to be in Zoning District LI (Light Industrial) as defined
by existing ordinances of the City of Delray Beach, Florida.
Section 5. That the land hereinabove described shall immediately
become subject to all of the franchises, privileges, immunities, debts,
obligations, liabilities, ordinances and laws to which lands in the City
of Delray Beach are now or may be subjected and persons residing thereon
shall be deemed citizens of the City of Delray Beach.
Section 6. That this annexation of the subject property, in-
cluding adjacent roads, alleys, or the like, if any, shall not be deemed
acceptance by the City of any maintenance responsibility for such roads,
alleys, or the like, unless otherwise specifically initiated by the City
pursuant to current requirements and conditions.
Section 7. That if any word, phrase, clause, sentence or part of
this ordinance shall be declared illegal by a Court of competent jurisdic-
tion, such record of illegality shall in no way affect the remaining
porti on.

Section 8. That this ordinance shall become effective immedi-
ately upon passage on second and final reading.
