ORDINANCE NO. 117-85
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AMENDING CHAPTER 17, "PARKS,
BEACHES AND RECREATION", OF THE CODE OF ORDINANCES
OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING
ARTICLE II, "MUNICIPAL BEACH", BY AMENDING SECTION
17-31, "STORING BOATS", BY AMENDING SUBSECTION (E)
TO PROVIDE THAT THE MAXIMUM NUMBER OF BOAT STORAGE
PERMITS WILL BE DETERMINED BY THE CITY MANAGER; AND
BY AMENDING SUBSECTION (F) TO STATE THAT PERMITS
SHALL BE MADE AVAILABLE FIRST TO RESIDENTS AND THEN
TO NON-RESIDENTS, AND BY PROVIDING THAT THE PERMIT
FEES SHALL BE ONE HUNDRED DOLLARS ($100.00) FOR
RESIDENTS AND ONE HUNDRED FIFTY DOLLARS ($150.00)
FOR NON-RESIDENTS; PROVIDING A REPEALER CLAUSE;
PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE
DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
~_~. That Section 17-31 (e) of the Code of
Ordinances of the City of Delray Beach, Florida, be, and the same is
hereby amended to read as follows:
(e) The owner of a boat who desires to store it in the area
designated above shall make application to the city administration
for a boat storage permit, which application shall be in' a form to
be prescribed by the city administration containing as a minimum
the name and address of the boat owner, together with any iden-
tifying registration numbers of such boat issued by other govern-
mental agencies, and the type or model of boat for which
application is being made. The maximum number of boat storage
permits which the city administration may have outstanding at any
time ~s-~-h~-~. shall be determined by the City Manager but
shall not exceed the number permitted under the regulatiQns.

~9_~. That Section 17-31 (f) of the Code of
Ordinances of the City of Delray Beach, 'Florida, be, and the same is
hereby amended to read as follows:
(f) Permits for the storage of boats shall be made available
first to City residents and then to non-residents in accordance
with the pro,ram set up by the City Manage~. The permit fee to be
submitted with the application sh~ll be ~ey one hundre~ dollars
~$~eT00} ($100.00) and shall be one hundred fifty dollars ($150.00)
for non-residents. -
$~_~. That all ordinances or parts of ordinances
which are in conflict herewith are hereby repealed.
~_9_~. That should any section or provision of this
ordinance or any portion thereof, any paragraph, sentence, or word be
declared by a court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as a
whole or part thereof other than the part declared to be invalid.
~. That this ordinance shall become effective
immediately upon passage on second and final reading.
