SIDE OF LINTON BOULEVARD, BETWEEN GERMANTOWN ROAD & SWINTON AVENUE ORDINANCE NO. 121-85 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, .FLORIDA, A~'~EXING TO THE CITY OF DELRAY BEACH' LOTS 22 THROUGH 26, INCLUSIVE, AND LOTS 48 THROUGH 51, IN- CLUSIVE, LESS THE SOUTH' 30.00 FEET THEREOF, SANDS O'SEA SUBDIVISION, ACCORDING TO THF PLAT THEREOF, TOGETHER WITH ALL OF PRINCESS BOULEVARD AS SHOWN ON SAID PLAT LYING SOUTH' OF SAID LOTS 22 THROUGH 26, INCLUSIVE, LESS THE SOUTH' ONE-HALF (S½) OF PRINCESS BOULEVARD LYING NORTH' OF LOTS 47 AND 52 OF SAID "SANDS O'SEA" ALL AS RECORDED IN PLAT BOOK 21, PAGE 27, OF THE PUBLIC RECORDS OF PAI~4 BEACH COUNTY, FLORIDA, WHICH LAND IS CONTIGUOUS TO EXIST- ING MUNICIPAL LIMITS OF SAID CITY, SAID LAND IS LOCATED ON ThE NORTH SiDE OF LINTON BOULEVARD, BETWEEN GERMANTOWN ROAD AND. S.W. 10TH' AVENUE; REDEFINING THE BOUNDARIES OF SAID CITY TO INCLUDE SAID LAND; PROVIDING FOR THE RIGHTS AND OBLIGATIONS OF SAID LAND; PROVIDING FOR THE ZONING THEREOF; PROVIDING AN EFFECTIVE DATE. WHEREAS, Baron Coleman and Goldsmith Investment Corporation of Florida, Inc., d/b/a B.G. Enterprises, are the fee-simple owners of Lots 22 through 26, Sands O'Sea, according to the Plat thereof recorded in Plat Book 21, Page 27 of the Public Records of Palm Beach County, Florida; and, WHEREAS, Mark A. Perry, Trustee, is the fee-simple owner of Lots 48 through 51, less the south 23 feet thereof, Sands O'Sea, according to the Plat thereof recorded in Plat Book 21, Page 27 of the Public Record~ of Palm Beach County, Florida; and, WHEREAS, Baron Coleman and Goldsmith Investment Corporation o~ Florida, Inc., d/b/a B.G. Enterprises and Mark A. Perry, Trustee, have authorized Tradewinds Development Corp., Digby Bridges, Marsh and Asso- ciates to act as agent; and, WHEREAS, Tradewinds Development Corp., Digby Bridges, Marsh and Associates, as agent, have requested by their petition to have the prop- erty annexed into the municipal limits of the City of Delray Beach; and, WHEREAS, the designation of a zoning classification is part of the annexation proceeding, the City Council has determined that the pro- cedures set forth in Section 30-23 of the Zoning Code, which applies to property already in the City limits, shall not be applicable in annexation proceedings; and, WHEREAS, the City of Delray Beach has heretofore been authorized to annex lands in accordance with Section 171.044 of the Florida Statutes NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY O] DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City Council of the City of Delray Beach, Palm Beach County, Florida, hereby annexes to said City the following described land located in Palm Beach County, Florida, which lies contigu- ous to said City to-wit: A parcel of land lying in Section 20, 'i'ownship 46 South, Range 43 East, Palm Beach County, Florida, being a por- tion of "SANDS O'SEA", according to the plat thereof, as recorded in Plat Book 21, Page 27 of the Public Records of Palm Beach County, Florida, more particularly de- scribed as follows: COMMENCING at the Southeast corner of Lot 48 of said "SANDS O'SEA"; thence Northerly along the East boundary thereof a distance of 30.03 feet to a point of inter- section with a line 30.00 ~et North of and parallel with the South boundary of said "SANDS O'SEA"; said point being the POINT OF BEGINNING of this description; thence continue Northerly along the East bgundary of said Lot 48, a distance of 123.82 feet to a point of intersection with the centerline of Princess Boulevard as shown on said plat; thence Easterly with a measured angle of 267° 40' 41" from the last described course along said center- line, a distance of 100.01 feet to a point of inter- section with the Southerly projection of the East bound- ary line of Lot 26 of said "SANDS O'SEA"; thence North- erly with a measured angle of 92° 19' 19" from the last described course along said East line, a distance of 150.02 feet to the Northeast corner thereof; thence Westerly with a measured angle of 87° 40' 41" from the last described course along the North boundary line of Lots 22-26 of said "SANDS O'SEA", a distance of 510.66 feet to a point of intersection with the East line of the 60.00 foot wide Right-of-Way for Germantown Road as shown on said plat; thence Southerly with a measured angle of 114° 55' 33" from the last described course along said East line, a distance of 142.55 .feet to a point of inter- section with the centerline of aforesaid Princess Boul- evard; thence 5asterly with a measured angle of 90" 00' 00" from the last described course along said centerline a distance of 48.95 feet; thence continuing Easterly along said center line for Princess Boulevard with a measured angle of 155" 04' 27" from the last described course, a distance of 45.22 feet to a point of inter- section with the Northerly projection of the West bound- ary for Lot 51 of said "SANDS O'SEA"; thence Southerly with a measured angle of 272" 19 ' 19" from the last described course along said West line, a distance of 124.51 feet to a point of intersection with a line 30.00 feet North of and parallel to the South boundary of said "SANDS O'SEA"; thence Easterly with a measured angle of 87" 34' 23" from the last described course along said parallel line, a distance of 375.06 feet to the POINT OF BEGINNING. Said lands situate in the City of Delray Beach, Pal~ Beach County, Florida. ALSO DESCRIBED AS Ail of Lots 22-26, and 48-51, less the South 30.00 feet thereof, SANDS O'SEA, according to the plat thereof, as recorded in Plat Book 21, Page 27 of the Public Records of Palm Beach County, Florida. together with Ail of Princess Boulevard as shown on said plat lying South of said Lots 22-26 LESS the South one-half (S½) of Princess Boulevard lying North of Lots 47 and 52 of said "SANDS O'SEA". Said land situate in the City of Delray Beach, Palm Beach County, Florida. The subject property is located on the north side of Linton Boulevard, between Germantown Road and S.W. 10th Avenue. - 2 - Ord. No. 121-85 The above-described parcel contains a 3.0363 acre parcel of land, more or less. Section 2. That the Boundaries of the City of Delray Beach, Florida, are hereby redefined to include therein the above-described tract of land and said land is hereby declared to 'be within the corporate limits of the City of Delray Beach, Florida. Section 3. That Section 30-23 of the Zoning Code shall not apply to the establishment of a zoning classification in this ordinance. Section 4. That the tract of land hereinabove described is hereby declared to be in Zoning District POC (Planned Office Center) as defined by existing ordinances of the City of Delray Beach, Florida. Section 5. That the land hereinabove described shall immediately become sub3ect to all of the franchises, privileges, immunities, debts, obligations, liabilities, ordinances and laws to which lands in the City of Delray Beach are now or may be subjected and persons residing thereon shall be deemed citizens of the City of Delray Beach. Section 6. That this annexation of the subject property, in- cluding adjacent roads, alleys, or the like, if any, shall not be deemed acceptance by the City of any maintenance responsibility for such roads, alleys, or the like, unless otherwise specifically initiated by the City pursuant to current requirements and conditions. Section 7. That if any word, phrase, clause, sentence or part of this ordinance shall be declared illegal by a Court of competent jurisdic- tion, such record of illegality shall in no way affect the remaining portion. Section 8. That this ordinance shall become effective immedi- ately upon passage on second and final reading.
