AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH', FLORIDA, AMENDING CHAPTER 30, "ZONING", OF THE
CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH' BY AMEND-
ING SECTION 30-13 CBD (CENTRAL BUSINESS) DISTRICT (A)
"PURPOSL" TO REQUIRE ALL ADDITIONS AND CONSTRUCTION IN
THE CBD TO BE SUBJECT TO SITE AND DEVELOPMENT PLAN AP-
PROVAL AND PROVIDING THAT NOTIFICATION OF ALL CON-
STRUCTION AND ADDITIONS SHALL BE PROVIDED TO THE DOWNTOWN
DEVELOPMENT AUTHORITY AND THE COMMUNITY REDEVELOPMENT
AGENCY; PROVIDING A REPEALER CLAUSE; PROVIDING A SAVING'
CLAUSE; PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1: That Section 30-13 CBD (Central Business) District
(A) "Purpose", of the Code of Ordinances of the City of Del~ay Beach,
Florida, is hereby amended to read as follows:
(a) PURPOSE
The CBD zoning district is intended to provide an area for
retail commercial activities located in completely en-
closed buildings and to preserve and develop the character
of the businesses presently conducted within the bound-
aries of the Downtown Development Authority as set forth
in the Act creating the Authority by the Special Acts of
Florida, 1971, as amended. All plans for new construction
and additions in the CBD (Central Business District) wh~eh
~-~7~-~-~-.-~-~ee~-~-~e~ shall be subject to
Sec. 30-22 Site and Development Plan approval. Further,
notification of any such new construction and/or additions
shall be provided to the Downtown Development Authority
and Community Redevelopment Agency, who may make ~ their
recommendations known to the Planning and Zoning Board.
All other appropriate City boards, commissions, and com-
mittees may make their recommendations and comments to the
Planning and Zoning Board prior to their review of the
site and development plans.
Section 2. That all ordinances or parts of ordinances which are
in conflict herewith are hereby repealed.
Section 3. That should any section or provision of this ordi-
nance or any portion thereof, any paragraph, sentence, or word be declared
by a Court of competent jurisdiction to be invalid, such decision shall
not affect the validity of the remainder hereof as a whole or part thereof
other than the part declared to be invalid.
Section 4. That this ordinance shall become effective ten days
after passage on second and final reading.
