W~EREAS, the Planning and Zoning Board, at the meeting hel~ on December 19, 1983, recommended rezoning and placing land presently' zoned PRD-4 (Planned Residential) District, in SAD (Special Activities; Dis- trict, with certain expressed conditions; and, WHEREAS, the City Council has determined that such chang'e should be made, NOW,, THEREFORe., BE IT ORDAINED BY TH5 CITY COUNCIL OF TH5 CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the following described property' in the City of Delray Beach, Florida, is hereby rezoned and placed in the SAD (Special Activities) District as defined in Chapter 30 o~ the Code o~ Or~lnances of the City of Delray Beach~ Florida, to-wit: A portion of Section 8, Township 46 South, Range 43 East, more particularly described as follows: Beginnin9 at the northwest corner of Lot 17, Lake Ida ~anor Addition No. 2, as recorded in Plat ~ook 25, Pa~e 61~, Public Records of Palm Beach County, Florida; thence run. Containing 40.73 acres more or less and subject to easements and r~hts- of-way of record. The subject property is located at the northeast corner of Lake Ida Road and 1-95. Section 2. That conditional use and site and development plan approvals for the subject property described in Section 1, above, are hereby granted subject to the followin9 expressed conditions: (a) The only conditional uses to be permitted hereunder are as follows: To allow multiple family and zero lot line single family housing with their attendant recreational facilities. (b) Prior to development of this property and receiving any building permits therefore, the subject development ls required to meet the platting requirements set forth in the City's Subdivision Ordinances, Chapter 24 of the Code of Ordinances. (c) That all signs and pavement markings constructe~ or erected by the developer must be in accordance with ~STCb s~ecifications. (d) The drainage of the subject project shall De maintained on site or out through the storm sewer system an~ no drainage will be allowed to flow over land onto ad3acent property. (e) There shall be no dumpsters, cluster bo×es, trees, shrubs or structures permitted on an~ easements or rights-of-way shown on the plat. (f) This approval is subject to the requirement that all irrigation for this pro3ect shall be from a source other than City water, i~ such water is suitable for ~rr~ga- tion. (g) That, prior to issuance of any building permits, the developer shall at its own expense submlt a traffic impact analysis. - 2 - Ord. No. 3-84 (h) That, prior to the issuance of any building permits, the developer shall dedicate 50' of right-of-way for N.W. 8th Avenue. (i) That existing Southern Bell cable easements be retained where possible, that new easements be provided where necessary, and that any relocation of cables and any new easements be accomplished by the developer and at the developer' s expense. (j) That the number of units as shown on the site and develop- ment plan approved in Section 3, below, shall be reduced by deleting Unit Numbers 87 through 91, inclusive, from the site plan and development. (k) That the tennis courts as shown on the site and develop- ment plan approved in Section 3, below, shall be con- structed with a depth of 120 feet, and may deviate from their indicated location to comply herewith. Section 3. That the development of the proDect described in Section 1 is to be in accordance with the approved site and development plans, as modified by this ordinance, re: The Isles of Delray, Delray Beach, Florida, prepared by Sanders Planning Group, P.A., 2425 East Com- mercial Boulevard, Suite 101, Fort Lauderdale, FL 33308, Sheet Nos. P-i, P-4, P-5, P-6, P-7 dated January 6, 1984 and Sheet No. P-2 dated July i, 1983 and Sheet No. P-3 dated June 3, 1983; and prepared by Richard L. ~ Shepar~ and Associates, Inc., Land Surveyors, 310 South Federal Highway, P.O. Box 759, Boynton Beach, FL 33435, Sheet Nos. $-1, S-2 dated June 13, 1983; and prepared by Shalloway, Inc., Consulting Engineers, 932 North Dixie Highway, Lake Worth, FL 33460, Sheet Nos. C-I, C-2, C-3 dated 1983; and prepared by Jeffrey K. Hirschberg, Architects & Planners, 11~ East Atlantic Avenue, Suite 410W, Delray Beach, FL 33444, Sheet No. A-1 dated June 3, 1983 and Sheet No. A-2 dated November 17, 1983; all of which are incorporated by reference and made a part hereof and upon which the City has relied in granting this approval. Section 4. That the time limitation of this approval Fursuant to Section 30-21(E) and 30-22(E) of the Zoning Code shall be twenty-four (2%) months from the date when all other approvals for re%uired City building permits have been received. Section 5~ That the Planning Director of said City shall, upon the effective date of this ordinance change the Zoning hap or Delra~ Beach, Florida, to conform with the provisions of Section 1, hereof. Section 6, That any building permits issued by the City shall De subject to substantial construction, consisting of footings and slabs as a minimum, being accomplished by the developer within 120 days of Duildln9 permit issuance, otherwise said building permits to be null and voi~ in the absence of the aforesaid construction progress; however said voiding of the building permits shall not effect the approvals otherwise seu forth in this ordinance and the developer may re-apply for new buildin9 permits. Section 7. That this ordinance shall become e~fective ten day's after passage on second and final reading.
