12-84 ORDINANCE NO. 12-84 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ZONING AND PLACING LAND PRE$SNTLY IN THE COUNTY OF PALM BEACH WITH COUNTY ZONING OF AR (AGRI- CULTURAL RESIDENTIAL) DISTRICT , IN THE CITY ZONING SAD (SPECIAL ACTIVITIES DISTRICT), BEING A 4.67 ACRE PARCEL · OF LAND LOCATED NORTH OF ATLANTIC AVENUE BETWEEN HIG~ POINT BOULEVARD AND HA~'~.ET DRIVE, IF EXTENDED NORTH, SAID LAND BEING IN SECTION 18, TOWNSHIP 46 SOUTH, RANGE 43 EAST; GRANTING CONDITIONAL USE AND SITE ~D DEVELOPS~NT PLAN APPROVAL; PROVIDING A GENERAL REPEALER; AND A~NDING "ZONING MAP' OF DELRAY BEACH FLORIDA, 1983". WHEREAS, the Planning and Zoning Board, at the meeting held on January 16, 1984, recommended annexation and the zoning and placin~ of land presently in the County of Palm Beach with County Zoning of AR (Agri- cultural Residential) District, in the City Zoning SAD (Special Activities District); and, WHEREAS, the .City Council has determined that such change should be made, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: s~ction' ~ That the following described property upon annexation into the City of Delray Beach, Florida, is hereby zoned and placed in the SAD (Special Activities District) as defined in Chapter 30 of the Code of Ordinances of the City of Delray Beach, Florida, to-wit: The' West one-half (W½) of the Southwest one-quarter (SW~) of the Northwest one-quarter (NW~) of %he Southwest one-quarter (SW%), lying North of State Road 806, of Section 18, Township 46 South,' Range 43 East, Palm Beach County, Florida. The subject property is located north of Atlantic Avenue between High Point Boulevard and Hamlet Drive, if ex- tended north. The above-described parcel contains a 4.67 acre parcel of land, more or less. section'2. That conditional use and site and development plan approvals for the subject property described in Section 1, above, are hereby granted subject to the following expressed conditions: (a) The only conditional use to be permitted hereunder is as follows: Professional and general offices. (b) Prior to developn~ent of this property an~ receivin9 any building permits therefore, the subject developmen~ ~s reqUired to meet the platting requirements set tortn in the City's Subdivision Ordinances, Chapter 24 of the Code of Ordinances. ( c ) That al 1 signs an~ pavement markings constructed or erected by the developer must be in accordance with hUTCh specifications. (d) The drainage of the sub]ect pro3ec= shall be maintained on site or out throu9h the storm sewer system and no drainage will be allowed to ~low over land onto adjacent property. (e) There shall be no dumpSters, cluster boxes, trees, shrubs or structures permitted on any easements or rights-of-way shown on the plat. (f) This approval is subject to the requirement that all irrigation for this project shall be from a source other than City water, if such water is suitable for irriga- tion. (g) That, prior to the issuance of any building permits, the developer shall submit to Public Utilities a copy of the executed agreement between the property owner and High Point allowing the sanitary sewer line from this project' to be connected to mains within High Point. (h) That, prior to the issuance of any building permits, the developer shall obtain a variance reducing the required number of parking spaces from 282 to 225. (i) That the developer satisfies all conditions set forth by the Director of Public Utilities relative to the connec- tion of the subject project to the existing gravity sewer system in High Point Section 1. $~tion-3'. Caulfield and %~neeler, Inc., Land Surveyors, Consulting Engi- neers, 2290 N.W. Second Avenue, Suite 3, Boca Raton, FL 33432, Sheet Nos. C-1, C-2 dated January 5, 1984 and prepared by Robert E. Ancipink, Archi- tect & Planner, 2401 Morris Ave., Union, NJ, Sheet No. A-1 dated November 11, 1983; all of which are incorporated by reference and made a i~art hereof and upon which the City has relied in granting this approval. section' 4, That the time limitation of this approval pursuant to Section 30-21(E) and 30-22 (E) of the Zoning Code shall be eighteen (18) months from the effective date of this ordinance. SeCtiOn 5. That the Planning Director of said City shall, upon the effective date of this ordinance change the Zoning ~]ap of Delray Beach, Florida, to conform with the provisions of Section 1, hereof. section' 6~ That any building permits issued by the City shall be subject to substantial construction, consisting o~ footings and slabs as a minimum, being accomplished by the developer within 120 days of building permit issuance, otherwise said building permits to be null and void in the absence of the aforesaid construction progress. Section 7'. That this ordinance shall become effective ten days after passage on second and final reading. Section 8, That all ordinances or parts of ordinances in con- flict herewith be and the same are hereby repealed.
