COUNTY, APRIL 13, 1982, WHICH LAND IS CONTIGUOUS TO
EXISTING MUNICIPAL LIMITS OF SAID CITY; REDEFINING THE
BOUNDARIES OF SAID CITY TO INCLUDE SAID LAND; PROVIDING
FOR THE RIGHTS AND OBLIGATIONS OF SAID LAND; AND PROVID-
ING FOR THE ZONING THEREOF.
WHEREAS, Roger Boos, President of R.C. Boos Construction, Inc.,
is tke fee-simple owner or the grantor and preceding fee-simple owner,
the property hereinafter described; and,
WHEREAS, Roger Boos, President of R.C. Boos Construction, Inc.,
has ~.equested pursuant to agreement dated October 6, 1981, and recorded in
Official Record Book 3638, Pages 0248, 0249 and 0250, which agreement was
a covenant for annexation running with the property hereinafter described,
to have the subject property annexed into the municipal limits of the City
of Delray Beach; and,
WHEREAS, the subject property hereinafter described is now con-
tiguous to the corporate limits of the City of Delray Beach, thus making
said petition for annexation effective at this time; and,
%~EREAS, the designation of a zoning classification is part
the annexation proceeding, the City Council has determined that the pro-i
cedures set forth in Section 30-23 of the Zoning Code, which applies to:
property already in the City limits, shall not be applicaDle in annexation
proceedings; and,
%~{EREAS, the City of Delray Beach has heretofore been author~zed~
to annex lands in accordance with Section 171.044 of the Florida Statutes,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TH~ CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
S~ction~ I. That the City Council o~ the City of Delray Beach,
Palm Beach County, Florida, hereby annexes to said City the following
described land located in Palm Beach County, Florida, which lies contigu-
ous to said City to-wit:
Lots 1 through 24, inclusive, of Block 11, Lots 1 throu9'h
11, inclusive, of Block 12 of Southridge, according to
the Plat thereof as recorded in Plat Book 13, Pages 3&
and 39, Public Records of Palm Beach County, Florida.
That portion of Central Avenue adjacent to Lots 14 and
15, Block 11 vacated per Resolution No. R-80129~ as
recorded in Book 3298, Page 639, Public Records of Palm
Beach County, Florida.
The North two-fifths (2/5) of the following described
property: Northeast Quarter (NE%) of Lot 8, Delray
Beach, a subdivision of Section 20, Township 46 South,
Range 43 East, Plat Book 1, Page 4, Public Records of
Palm Beach County, Florida.
Also Glen Avenue, lying within Southridge Subdivision and
between Blocks ll and 12 as abandoned by Resolution No.
R-82-419, Palm Beach County, April 13, 1982.
Subject to easements and rights-of-way of record.
The subject property is located north of Linton Boulevar~
between S.W. 8th Avenue and S.W. 4th Avenue.
The above-described parcel contains a 7.3 acre parcel of
land.
F~ti~n'2. That the Boundaries of the City of Delray 'Beach,
Florida, are hereby redefined to include therein the above-described tract
of land and said land is hereby declared to be within the corporate limits
of the City of Delray Beach, Florida.
SeCtiOn 3. That Section 30-23 of the Zoning Code shall not apply
to the establishment of a zoning classification in this ordinance.
Section 4 ~ That the tract of land hereinabove described is
hereby dec'lared to be in Zoning District RM-10 (Multiple Family Dwelling)
as defined by existing ordinances of the City of Delray Beach, Florida.
SeCtiOn 5. That the land hereinabove described shall immediately
become subject to all of the franchises, privileges, immunities, debts,
obligations, liabilities, ordinances and laws to which lands in the City
of Delray Beach are now or may be subjected and persons residing thereon'
shall be deemed citizens of the City of Delray Beach.
Section' 6. That this annexation of the sub3ect property, in-
cluding adjacent roads, alleys, or the like, if any, shall not De deemed
acceptance by the City of any maintenance responsibility for such roads,
alleys, or the like, unless otherwise specifically initiated Dy the City
pursuant to current requirements and conditions.
SeCtion 7. That if any word, phrase, clause, sentence or part of
this ordinance shall be declared illegal by a Court of competent 3uris~ic-
tion, such record of illegality shall in no way affect the remaining
portion.
