AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 11, "FIRE PROTECTION
AND PREVENTION", ARTICLE II, "FIRE PREVENTION" OF THE
CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA,
BY AMENDING SECTION 11-17, "CODES ADOPTED", TO SPECIFY
THAT THE REGULATIONS SET FORTH IN THE 1981 EDITION OF
THE NFPA PAMPHLET 101 OF THE LIFE SAFETY CODE SHALL BE
IN FORCE IN THE CITY nF DELRAY BEACH; PROVIDING A SAV-
ING CLAUSE: PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Section 11-17, "Codes adopted", of the Code of
Ordinances of the City of Delray Beach, Florida, be and the same is hereby
amended to read as follows:
Sec. 11-!7. Codes adopted.
There is hereby adopted by the city for the purpose of prescribing
regulations governing conditions hazardous to life and property from fire
or explosion, those certain codes known as the 1976 Edition of the Fire
Prevention Code and the 1976 Revision of the Fire Prevention Code,
Article 31, prescribed by the American Insurance Association and the six-
teen (16) volume set of the 1978 Edition of the National Fire Codes,
prescribed by the National Fire Protection Association, including all re-
visions, save and except such portions as are hereinafter deleted,
modified or amended, except for the NFPA Pamphlet 101 of the Life Safety
Code (of the 16 volume National Fire Code), which will be the 1981 edition
of which codes not less than one (1) copy has been and is now filed in the
office of the clerk of the city and the same are hereby adopted and in-
corporated as fully as if set out at length herein, and the provisions
thereof shall be controlling within the limits of the city.
Section 2. That should any section or provision of this ordinance
or any portion thereof, any paragraph, sentence, or word be declared by
a court of competent jurisdiction to be invalid, such decision shall not
affect the validity of the remainder hereof as a whole or part thereof
other than the part declared to be invalid.
Section 3. That this ordinance shall become effective ten (10)
days after its passage on second and final reading.
