AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, ZONING AND PLACING LAND WHICH I$ PRES-
ENTLY ZONED RM-10 (MULTIPLE FAMILY DWELLING) DISTRICT, IN
SAD (SPECIAL ACTIVITIES DISTRICT), BEING A 1.63 ACRE
PARCEL OF LAND LOCATED EAST OF FEDERAL HIGHWAY BETWEEN
AVENUE "H" AND AVENUE "J", SAID LAND BEING IN BLOCKS 27
AND 28 ACCORDING TO THE PLAT OF DEL RATON PARK SUBDIVI-
SION, AS RECORDED IN PLAT BOOK 14, PAGES 9 AND 10, OF THE
PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA, AKA DUMAR
PLAZA, A SUBDIVISION AS RECORDED IN PLAT BOOK 44, PAGES
188 AND 189 OF THE PUBLIC RECORDS OF PALM BEACH COUNTY,
FLORIDA, LESS THE WEST 118 FEET OF DUMAR PLAZA, GRANTIN~
CONDITIONAL USE AND SITE AND DEVELOPMENT PLAN APPROVAL
AND AMENDING "ZONING MAp OF DELRAY BEACH, FLORIDa, 1983".
WHEREAS, the Planning and Zoning Board, at the meeting held on
January 16, 1984, recommended rezoning and placing land presently zone~
RM-10 (Multiple Family Dwelling) District, in SAD (Special Activities
District), with certain expressed conditions; and,
;~EREAS, the City Council has determined that such change should
be made,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH , FLORIDA, AS FOLLOWS:
SeCtion I'. That the following described property in the City of
Delray Beach, Florida, is hereby rezoned and placed in the SAD (Special
Activities District) as defined in Chapter 30 of the Code of Ordinances of
the City of Delray Beach, Florida, to-wit:
Lots 1-5 and Lots 33-42, Block 28 less the Westerly 38.0
feet of said Lots 1-5, also including Lots 6-20, slock
27, less the Westerly 38.0 feet of said Lots 6-i0, also
including that portion of vacated Avenue I as described
in ORB 1942, PB 623 lyin9' between said Blocks 27 and 28,
also including that 10 foot vacated alley between Lots
1-3 and Lot 42; Block 28, as described in OR~ 2631, Pgs
599-600, also including that 10 foot alley lying between
Lots 6-10 and Lot 11, Block 27, as ~escribed in DB 1153,
Pgs 317-319 according to the plat of Del Raton Park
Subdivision, as recorded in Plat Book 14, Pages 9 and 10,
of the Public Records of Palm Beach County, Florida; AK~
Dumar Plaza, a subdivision as recorded in Plat Book 44,
Pages 188 and 189 of the Public Records of Palm Beach
County, Florida. LESS the West 118 feet of Dumar Plaza.
The subject property is located East of Federal Highway
between Avenue H and Avenue J, Delray Beach, Florida.
The above-described parcel contains a 1.63 acre parcel of
land, more or less.
~e~tion 2~ That conditional use and site and development plan
approvals for the subject property described in Section 1, above, are
hereby granted subject to the following expressed conditions:
(a) The only conditional uses to be permitted hereunder are
as follows:

Optometrists
Opticians
Physicians
Chiropractors
Physical Therapists
Specialist Physicians
Attorneys
Travel Agents
Accountants
Bookkeeping Offices

Secretarial Service, Including Word Processing
SeCtiOn'3% That all improvements be in accordance with the
approved site plans re: Dumar Plaza, Delray Beach, Florida, prepared by
Everardo R. Garcia, Architect, 290 E. Fern Drive, Boca Raton, Florida,
Sheet No. A-i, revised June 6, 1983 and June 24, 1983 and December 2,
1983, Sheet Nos. A-2 through A-8 dated March 30, 1982; all of which are
incorporated by reference and made a part hereof and upon which the C~ty
has relied in granting this approval.
Section-4. That the Plannin9 Director of said C~ty shall, upon
the effective date of this ordinance change the Zoning hap of Delrak-
Beach, Florida, to conform with the provisions of Section 1, hereof.
section-5', That any building permits issued by the ~i~y shall be
subject to substantial construction, consistin9 of footings and slaps as a
minimum, being accomplished by the developer within 120 day~ of building
permit issuance, otherwise said building permits to Se null and void in
the absence of the aforesaid construction progress.
~ettion 6'. That this ordinance shall become effective ten days
after passage on second and final reading.
PASSED AND ADOPTED in regular session on second and final reading
