ORDINANCE NO. 26-84
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, ANNEXING TO THE CITY OF DELRAY BEACH A
PARCEL OF LAND LYING IN SECTION 4, TOWNb~IP 46 SOUTH,
RANGE 43 EAST, WHICH LAND IS CONTIGUOUS TO EXISTING
~UNICIPAL LISIITS OF SAID CITY, SAID LAND IS LOCATED SOUTH
OF GULFSTREAM BOULEVARD BETWEEN NORTH FEDERAL HIghWAY
DIXIE HIGHWAY; REDEFINING THE BOUNDARIES OF SAID CITY TO
INCLUDE SAID LAND; PROVIDING FOR THE RIGHTS AND OBLIGA-
TIONS OF SAID LAND; PROVIDING FOR THE ZONING THEREOF.
WHEREAS, James T. Adams and Hattie L. Adams, his wife, are
fee-simple owners of the property hereinafter described; and,
WHEREAS, James T. Adams and Hattie L. Adams, his wife, have
requested by their petition to have the property annexed into the munici-
pal limits of the City of Delray Beach; and,
WHEREAS, the designation of a zoning classification is part of!
the annexation proceeding, the City Council has determinea that the pro-
cedures set forth in Section 30-23 of the Zoning Code, which applies to
property already in the C~ty limits, shall not be applicable in annexation
proceedings; and,
~EREAS, the City of Delray ~each has heretofore been authorized
to annex lands in accordance with Section 171.044 of the Florida Statutes,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CItY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section I% That the City Council of the City of De lray Beacn, i
Palm Beach County, Florida, hereby annexes to said City the following!
described land located in Palm Beach County, Florida, which lies contigu-~
ous to said City to-wit:
A parcel of land in Section 4, Township 46 South, Range
43 East, Palm Beach County, Florida, more particularly
described as follows:
Beginning at the southwest corner of Lot 1-A of DEL~aY
BEACH ESTATES, according to the plat thereof recorded in
Plat Book 21, Page 13, of the Public Records of Palm
Beach County, Florida; thence southerly alon9 a line
parallel to, and 130 feet easterly {measured at right
angles) from the center line of the right-of-way of the
Florida East Coast Railway, and being in the easterly
line of the right-of-way of the Dixie Highway through
this parcel, 202.22 feet, more or less, to a point ina
line parallel to and 200 feet southerly (measured at
right angles) from the south line of said Lot 1-A of
DELRAY BEACH ESTATES; thence easterly along said parallel
line, 193.75 feet, more or less, to a point in the west-
erly right-of-way line of State Road No. 5 (U.S. Highway
No. 1); thence northerly along said westerly right-of-way
line and being a line parallel to, and 50 feet westerly
from, the center line of said State Road No. 5, 205.6
feet, more or less, to the southeast corner of said Lot
1-A of DELRAY BEACH ESTATES; thence westerly alon9 the
south line of said Lot i-A, 211.49 feet to the point of
beginning;
LESS a triangular parcel of land as described in Deed
Book 1012, Page 395, of the Public Records of Palm Beach
County, Florida, which is described as: Beginning at the
intersection of the easterly right-of-way line of the
Dixie Highway with a line parallel to, and 200 feet
southerly (measured at right angles) from the south line
of DELRAY BEACH ESTATES, according to the plat thereof
recorded in Plat Book 21, Page 13, of the Public Records
of Palm Beach County, Florida; thence easterly along said
parallel line 193.75 feet, more or less, to a point in
the westerly right-of-way line of State Road No. 5 (U.S.
Highway No. 1); thence westerly to a point in the easter-
ly right-of-way line of said Dixie Highway 25 feet north-
erly, measured along said right-of-way, from the point of
beginning; thence southerly along said easterly right-
of-way line 25 feet to the point of beginning.
The subject property is located South of Gulfstream
Boulevard between North Federal Highway and Dixie High-
way.
The above-described parcel contains a 0.9 acre parcel of
land, more or less;
secti~n~2~ That the Boundaries of the City of Delray Beach,
Florida, are hereby redefined to include therein the above-described tract
of land and said land is hereby declared to be within the corporate limits
of the City of Delray Beach, Florida.
Section' 31 That Section 30-23 of the Zoning Code shall not apply
to the establishment of a zoning classification in this ordinance.
Section 4~ That the tract of land hereinabove described is
hereby declared to be in Zoning District GC (General Commercial) as de-
fined by existing ordinances of the City of De lray Beach, Florida.
Section 5. That the land hereinabove described shall immediately
become subject to all of the franchises, privileges, immunities, debts,
obligations, liabilities, ordinances and laws to which lands in the Citk
of De lray Beach are now or may be subjectea and persons residing thereon
shall be deemed citizens of the City of Delray Beach.
section 6. That this annexation of the suD]ect property, in-
cluding adjacent roads, alleys, or the like, if any, shall not be deemed
acceptance by the City of any maintenance responsibility ~or such roads,
alleys, or the like, unless otherwise specifically initiated by the City
pursuant to current requirements and conditions.
Secti~n~ 7'. That if any word, phrase, clause, sentence or part o~
this ordinance shall be declared illegal by a Court of competent jurisdic-
tion, such record of illegality shall in no way affect the remaining
portion.
