27-84 vOID ORDINANCE NO. 27-84 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, A~NDING CHAPTER 30 "ZONING" OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING SECTION 30-1, "DEFINITIONS" BY ADDING A NEW SUBSECTION TO ALLOW TELEPHONE SWITCHING STATIONS IN ALL ZONING DISTRICTS, WITH NO MINIMUM LOT AREA REQUIRED; A~NDING SECTION 30-17 "SUPPLES~NTARY REGULATIONS" BY ADDING A SUBSECTION (v) "TELEPHONE SWITCHING FACILITY"; PROVIDING A SAVING CLAUSE;-PROVIDING AN EFFECtiVE DATE. WHEREAS, the Planning and Zoning Board at a meeting held on 5~arc~ 19, 1984, recommended that Section 30-1 "Definitions" be amended by adding a new subsection to allow telephone switching stations in all zoning districts, with no minimum lot area required and amending Section 30-171 "Supplementary Regulations" by adding a subsection (v) "Telephone Switch-i ing Facility"; and, %~EREAS, the City Council of the City of Delray Beach, Florida,! deems it to be in the best interests of the residents and citizens of thet City of belray Beach to make such amendments, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OFI DELRAY BEACH, FLORIDA, AS FOLLOWS: se~ti~h~ I'~ That Chapter 30 "Zoning", Section 30-1 "Definitions"l of the Code of Ordinances of the City of Delray Beach, Florida, is hereby! amended by adding the following: Tel~h~ne'Swit~hih~ FaCiI~ty~ An unmanned, completely enclosed building for housing solid state electronic telephone switching equipment. Such facilities are permitted in all zoning districts subject to Sec. 30-17 (v) and Sec. 30-22 "Site Plan Approval." se~ti~-21 That Chapter 30 "Zoning", Section 30-17 "Supplemen- tary Regulations" of the Code of Ordinances of the City of Delray Beach,l Florida, is hereby amended by adding the following: (v) TELEP~ONE'SWITCHING'FACILIT¥ (1) De~Ihiti~h. A telephone switching facility is an unmanned, completely enclosed building for housing solid state electronic telephone switching equip- ment. Telephone switching facilities are permitted in all zoning districts subject to Sec. 30-22 "Site Plan Approval" and the requirements of this para- graph. No more than one such facility shall De permitted per site. (2) F1oo~'At~a~ A telephone switching facility shall not exceed 500 sq. ft. of total floor area. (3) LOt'A~a. There is no minimum lot size other than that required to accommodate the area for the build- ing, its setbacks and parking. (4) Builain~-setba~kS. The following shall be the minimum building setbacks for telephone switching facilities: (a) Front 25 ft. (b) Side (Interior) 10 ft. (c) Side (Street) 25 ft. (d) Rear 10 ft. (5) Buildin~-~ight% No telephone switching facility shall be constructed to a height exceeding fifteen (15) feet. (6) Parkih~. A telephone switching facility shall be provided with at least one, but not more than two, parking spaces. (7) Landscaping. In addition to the landscaping pro- visions oz Chapter 9, Article X, the following additional requirements shall apply: (a) A minimum ten (10) foot landscaping buffer shall be provided on all property lines. No less than six trees at least 12 ft. in height with six foot spread at time of planting shall be planted on the property. (b) Hedging and other landscaping shall be required as determined by the Planning and Zoning Board. (8) Ge~l. Telephone switching facilities shall comply with the following additional regulations: (a) No water or sewer connections shall be pro- vided, except as needed for irrigation. (b) Aesthetics will be consistent with the sur- rounding area. F~ttOh~3~ That should any section or provision of this ordi- nance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid.
