31-84 ORDINANCE NO. 31-84 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 30 "ZONING" OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING SECTION 30-1, "DEFINITIONS", SUBSECTION (84) TO CLARIFY THE DEFINITION OF STREET LINE TO INCLUDE THE RIGHT-OF-WAY LINE, EASEMENT LINE AND THE EDGE OF PAVEMENT OR EDGE OF TRAVELWAY; AMENDING SUBSECTION (89) TO CLARIFY THE DEFINITION OF TOWNHOUSE TO REQUIRE THAT SUCH "TOWN- HOUSES" BE CONVEYED ALONG WITH THE LOT OCCUPIED BY THE DWELLING UNIT; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Chapter 30 "Zoning", Section 30-1, Definitions", Subsection (84) "Street Line" and Subsection (89) "Townhouse", of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended to read as follows: (84) Street Line. A dividing line between land and a contiguous street. This line includes right-of-way line~ easement line~ and the edge of pavement or edge of travelwa¥ in a parking tract. (89) Townhouse. A building or structure designed for or occupied by no more than one (1) family or house- hold, and attached to at least two (2) or more similar buildings or structures by not more than two (2) party walls extending from the foundation to the roof, and providing two (2) direct means of access from the outside. Each dwelling unit shall contain cooking, sleeping, and sanitary facilities for use by each family or household of the townhouse. In order to qualify as such a townhouse pursuant to this Chapter~ each individual townhouse unit shall have fee simple ownership of the lot occupied by that unit. In addition, each individual townhouse lot shall be platted in accordance with the provi- sions of Chapter 24 of the City's Code of Ordinances. [See Sec. 30 -17(P)] Section 2. That should any section or provision of this ordi- nance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 3. That this ordinance shall become effective ten days after passage on second and final reading.
