36-84 ORDINANCE NO. 36-84 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 29, "WATER AND SEWERS", ARTICLE II, "WATER SERVICE", DIVISION l, ~GENERALLY", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING SECTION 29-18, "RATES", SUBSECTION (b), "MONTHLY RATES", PROVIDING FOR WATER SERVICE RATES, FOR BOTH RESIDENTIAL AND NONRES- IDENTIAL CUSTOMERS, BOTH INSIDE AND OUTSIDE THE CITY, BASED UPON CERTAIN CUSTOMER, CAPACITY AND COMMODITY CHARGES TO INCREASE SAID CAPACITY CHARGES; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 29-18, "Rates", Subsection (b), "Monthly rates", of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended to read as follows: (b) The monthly rates (except for fire hydrants as set forth in Section 29-17) for water furnished by the water facilities or plant of the city to customers within and outside the corporate limits of the city, which unless otherwise indicated shall include the appropriate customer charges, capacity charges, and commodity charges for all customers, are hereby fixed as shown in the following schedule: Type of Customer Inside City Outside City Residential Customer Charge (per meter) $ 2.16 $ 2.70 Capacity Charge (charged to all 670½ 7.71 7~§½ 9.64 customers, per residential dwelling unit) Commodity Charge (per 1,000 gallons) 0.53 0.66 Nonresidential Customer Charge (per meter) $ 2.16 $ 2.70 Capacity Charge (based upon meter size): 3/4 and 1 inch meter 6~0~ 7.71 7~ 9.64 1 1/2 inch meter ~§0 l'f~ ½6~88 21-~ 2 inch meter ~4~08 ~ ~0~½0 ~ 3 inch meter ~4~½~ B-~ ~½ ~ 6 inch meter ~½6~½ 2~3-~' ~0~89 3~'~ Commodity Charge (per 1,000 gallons) 0.53 0.66 NOTE: Whenever both residential and nonresidential users are on the same meter, the capacity charge is to be computed as if each nonresidential user on said meter was a residential dwelling unit, or all the users shall be charged based on the nonresidential capacity charge rate, whichever is the greater. Section 2. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid.
