AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING C~APTER 30 "ZONING" OF THE CODE
OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY
AMENDING SECTION 30-17 "SUPPLEMENTARY REGULATIONS" BY
REPEALING SUB-PARAGRAPH (P) "TOWNHOUSES AND TOWNHOUSE
DEVELOPMENTS" AND ENACTING A NEW SUB-PARAGRAPH (P) "TOWN-
HOUSES AND TOWNHOUSE DEVELOPMENTS" TO PROVIDE REGULATIONS
RELATIVE TO SITE REQUIREMENTS, LOT REQUIREMENTS, LENGTH
OF TOWNHOUSE ROWS AND SUPPLEMENTARY PROVISIONS REGARDING
"CIRCULATION"; PROVIDING A SAVING CLAUSE; PROVIDING AN
EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 30 "Zoning", Section 30-17 "Supplemen-
tary Regulations", Sub-paragraph (P) "Townhouses and Townhouse Develop-
ments" is hereby repealed and a new Sub-paragraph (P) "Townhouses and
Townhouse Developments", be and the same is hereby enacted to read as
follows:
(P) TOWNHOUSES AND TOWNHOUSE DEVELOPMENTS
(1) Site Requirements
(a) The minimum site size and frontage shall be the
same as those for the Zoning District in which
the townhouse development is located.
(b) Minimum Usable Open Space. Not less than
twenty-five (25%) percent of the total area
shall be usable open space, either for recre-
ation or some other suitable use, public or
private. For the purpose of this section,
roads, driveways, garages and parking areas
shall not be construed as usable open space.
(c) Yard Requirements
(1) Front Yard. No building or structure
shall be constructed closer than twenty-
five (25') feet to any street line, in-
cluding side streets.
(2) Side and Rear Yards. No principal build-
ing or structure shall be located closer
than twenty-five (25') feet to the side or
rear line of the development site.
(2) Individual Townhouse Lot Requirements
(a) The lot for each individual townhouse unit
shall coincide with or exceed the slab area for
the dwelling unit.
(b) No more than two (2) adjacent dwelling units
may be constructed without providing a front
setback of not less than four (4') feet offset
front to rear.
(c) Platting. Each individual townhouse lot shall
be platted in accordance with the provisions of
Chapter 24 of the City's Code of Ordinances.
(3) The spacing between buildings shall be calculated
according to the formula in Sec. 30-17(Q) of the
Code. In no case, however, shall buildings be
located closer than twenty-five (25') feet for a
two-story or thirty (30') feet for a three-story
building.
(4) Length of Townhouse Row. No townhouse row shall
consist of more than eight (8) dwelling units or two
hundred (200') feet of length, whichever is smaller.
(5) Supplementary Provisions
Circulation. Service features, garages, park-
ing areas, and entrances to dwelling units
shall, where possible, be located on a side of
the individual lot having access to an interior
street or road. Walkways should be designed to
connect dwelling units with each other and
connect each dwelling unit with common open
space.
Section 2. That should any section or provision of this ordi-
nance or any portion thereof, any paragraph, sentence, or word be declared
by a Court of competent jurisdiction to be invalid, such decision shall
not affect the validity of the remainder hereof as a whole or part thereof
other than the part declared to be invalid.
Section 3. That this ordinance shall become effective ten days
after passage on second and final reading.
