41-84 ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 14, "3UNK, 3UNKYARDS AND AUTOMOTIVE REPAIRS", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDAs BY AMENDING SECTION lt~-2, "ABANDONED~ V/RECKEDs 3UNKED VEHICLES ON PRIVATE OR PUBLIC PROPERTY"s SUBSECTION (a)s "PROHIBITED"s TO DEEM A MOTOR VEHICLE INOPER- ATIVE AND/OR ABANDONED IF A VALID AND CURRENT MOTOR VEHICLE LICENSE IS NOT AFFIXED THERETO IN EXCESS OF THIRTY (30) CALENDAR DAYS; PROVIDING THAT THIS SECTION NOT APPLY TO MOTOR VEHICLES LOCATED ON PROPERTY OWNED OR LEASED BY AUTOMOTIVE DEALERSs NEW OR USED, POSSESSING A CURRENT, VALID, OCCUPATIONAL LICENSE; NOR SHALL THIS SECTION APPLY TO ANY ANTIQUE OR COLLECTOR VEHICLE REGISTERED WITH THE STATE OF FLORIDA; PROVIDING A SAVING CLAUSE; PROVIDING FOR REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE. NOV/, THEREFOREs BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACHs FLORIDAs AS FOLLOV/S: Section 1. That Section lg-2s "Abandoned, wrecked, junked vehicles on private or public property", Subsection (a), "Prohibited", of the Code of Ordinances of the City of Delray Beach, Florida, bas and the same is hereby amended to read as foUows: (a) Prohibited. It shall be unlawful to parks store or leave or permit parking or storing of any licensed or unlicensed motor vehicle of any kind, for a period of time in excess of seventy-two (72) hour? :hich is in rusted, wrecked, junkeds partially dismantled or inoperative, or abandoned conditions whe- .r attended or nots upon any public or private property within the city limit~ unless the same is comp,etely enclosed within a building, or unless it is in connection with a business enterprise lawfully situated and licensed for same. A motor vehicle shall be deemed inoperative and/or abandoned if a valid and current motor vehicle license is not affixed thereto in excess of thirtT (30) calendar daysi pr..oviding further that this section shall not apply to motor vehicles located on property owned qr leased by automobile dealers~ new or used~ possessing a current~ valid~ occupational license} nor shall this section apply to any antique or collector vehicle which is reKistered with the State of Florida~ pursuant to Florida Statutes~ Section 320.086: An antique vehicle is defined as any motor vehicle which is thirty-five (35) years of age or older; a collector vehicle is defined as any motor vehicle which is a milestone~ limited i~roduction, vehicle~ which may be used for display purposes as a "show car"~ which age may not have obtained thirty-f.i.ve (35) years~ and which is reRistered with the State Florida. Section 2. That should any section or provision of this ordinance or any portion thereof, any paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalids such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 3. That all ordinances or parts of ordinances which are in conflict herewith are hereby repealed. Section 4. That this ordinance shall become effective ten (10) days after its passage on second and final reading~ PASSED AND ADOPTED in regular session on second and final reading on this the 24th day of July ~ 198t~.
