AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, ZONING AND PLACING LAND WHICH IS PRES-
ENTLY ZONED RM-15 (MULTIPLE FAMILY DWELLING) DISTRICT, IN
SAD (SPECIAL ACTIVITIES) DISTRICT, BEING A 0.61 ACRE
PARCEL OF LAND LOCATED AT THE NORTHWEST CORNER OF CON-
GRE$$ AVENUE AND LOWSON BOULEVARD, SAID LAND BEING LOTS
1, 2 AND 3, GOLF PARK, ACCORDING TO THE PLAT THEREOF ON
FILE IN THE OFFICE OF THE CLERK OF THE CIRCUIT COURT IN
AND FOR PALM BEACH COUNTY, FLORIDA, IN PLAT BOOK 26, PAGE
141, GRANTING CONDITIONAL USE AND SITE AND DEVELOPMENT
PLAN APPROVAL AND AMENDING "ZONING MAP OF DELRAY BEACH,
FLORIDA, 1983"; PROVIDING FOR VOIDING OF BUILDING PER-
~ITS; PROVIDING A GENERAL REPEALER; PROVIDING AN EFFEC-
TIVE DATE.
WHEREAS, the Planning and Zoning Board, at the meeting held on
May 21, 1984 recommended rezoning and placing land presently zoned RM-15
(Multiple Family Dwelling) District, in SAD (Special Activities) District,
with certain expressed conditions; and,
WHEREAS, the City Council has determined that such change should
be made,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the following described property in the City of
Delray Beach, Florida, is hereby rezoned and placed in the SAD (Special
Activities) District as defined in Chapter 30 of the Code of Ordinances of
the City of Delray Beach, Florida, to-wit:
Lots L, 2 and 3, Golf Park, according to the Plat thereof
on file in the office of the Clerk of the Circuit Court
in and for Palm Beach County, Florida, in Plat Book 26,
Page 141.
The subject property is located at the northwest corner
of Congress Avenue and Lowson Boulevard.
The above-described parcel contains a 0.61 acre parcel of
land, more or less.
Section 2. That conditional use and site and development plan
approvals for the subject property described in Section 1, above, are
hereby granted subject to the following expressed conditions:
(a) The only conditional uses to be permitted hereunder are as
follows:
Medical laboratory
Medical offices
Pharmacy, limited to 1,175 sq. ft.
Professional and business offices
Travel agency
(b) That commercial vehicles shall not be permitted to utilize nor
park in the rear parking area which abuts 20th Court, and that
such rear parking area shall be properly screened.
(c) That one additional tree shall be provided at the
perimeter along the southern portion of the property
which abuts Congress Avenue in accordance with the
Landscape Code.
(d) That all improvements shall be completed before an
occupational license for any one of the expanded uses is
issued.
Section 3. That the development of the property described in
Section 1 is to be in accordance with the approved site and development
plans res South Congress Professional Center, Delray Beach, Florida,
prepared by Beril Kruger and Associates, 2601 North Federal Highway,
Delray Beach, FL 33444, Sheet Nos. 1 and 2, dated May 1, 1984.
Section 4. That the time limitation of this approval pursuant to
Section 30-21(E) and 30-22(E) of the Zoning Code shall be twelve (12)
months from the effective date of this ordinance.
Section 5. That the Planning Director of said City shall, upon
the effective date of this ordinance change the Zoning Map of Delray
Beach, Florida, to conform with the provisions of Section 1, hereof.
Section 6. That any building permits issued by the City shall be
subject to substantial construction, consisting of footings and slabs as a
minimum, being accomplished by the developer within 120 days of building
permit issuance, otherwise said building permits to be null and void in
the absence of the aforesaid construction progress.
Section 7. That all ordinances or parts of ordinances in con-
flict herewith be and the same are hereby repealed.
Section 8. That this ordinance shall become effective ten days
after passage on second and final reading.
PASSED AND ADOPTED in regular session on second and final reading
on this the 14th day of August , 1984.
