AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 2, "ADMINISTRATION",
ARTICLE IV, "INTERNAL AUDIT COMMITTEE", OF THE CODE OF
ORDINANCES O17 THE CITY OF DELRAY BEACH, FLORIDA, BY
AMENDING SECTION 2-71, "TERMS OF OFFICE", TO PROVIDE FOR
A LIMITATION ON SUCCESSIVE TERMS TO TWO (2) TERMS ON
THE INTERNAL AUDIT COMMITTEE; PROVIDING A SAVING
CLAUSE; PROVIDING FOR THE REPEAL OP ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, by ltmlting the number of successive terms that a member may
serve on this committee, the City Council of the City of Delray Beach, Florida deems
such l~mitation necessary for the promotion and participation of the citizens and
residents of Delray Beach, Florida, on this committee.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Section 9.-71, "Terms of office", of the Code of Ordinances
of the City of Delray Beach, Florida, be, and the same is hereby amended to read as
follow s: ..
Sec. 2-71. Terms of office.
Of the members first appointed to the internal audit committee, three (3) shsll
serve for one year, two (2) shall serve for two (2) years. The alternates appointed
initially shall serve for two (2) years. Any additional members appointed thereafter to
fill vacancies created by the expansion of the membership of said committee shall be
appointed for two (2) years. Thereafter members shall be appointed for two-year
terms; provided further that no member may serve more than two (2) successive terms
on this Committee.
Section 2. That should any section or provision of this ordinance or any
portion thereof, any paragraph, sentence, or word be declared by a court of competent
jurisdiction to be invalid, such decision shail not affect the validity of the remainder
hereof as a whole or part thereof other than the pa~t declared to be invalid.
Section 3. That all ordinances or parts of ordinances which are in conflict
herewith are hereby repealed.
Section 4. That this ordinance shall become effective ten (10) days after its
passage on second and final reading; and as to the limitation set forth herein on
successive terms, it shall be applicable to both current members and for all future
appointments or reappointments.
PASSED AND ADOPTED in regular session on second and final reading on this
the 28th day of August , 198 4 .
