65-84 ORDINANCE NO. 65-84 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 2, "ADMINISTRATION", ARTICLE VI, "CODES ENFORCEMENT", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING SECTION 2-104, "CODES ENFORCEMENT BOARD ESTAB- LISHED", SUBSECTION (b), "QUALIFICATION OF MEMBERS" TO BROADEN THE REQUIREMENTS FOR THE QUALIFICATION OF MEMBERS ON THE BOARD; AND BY AMENDING SUBSECTION (d), "VACANCIES AND REAPPOINTMENT", TO CORRECT A TYPOGRAPHICAL ERROR; PROVIDING A SAVING CLAUSE; PROVIDING FOR THE REPEAL OF ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Delray Beach, Florida is desirous of promoting the participation of its citizens and residents, the Council deems it neces- sary to broaden the qualifications for membership on this board. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 2-104, "Codes enforcement board established", Subseetion'-~-~--~ualiflcations of members", of the Code of Ordinances of the City of Delray Beach, Florida, be, and the same is hereby amended to read as follows: (b) Qualifications of members. Each re~'ular member and alternate member appointed to the board shall possess, in addition to experience or interest in the fields of zoning and building control, the following minimum qualifications, where appropriate: (1) The architect(s) and the engineer(s) shall be registered under the laws of Florida re~lating the practice of architecture and engineering, or shall possess similar qualifications under the laws of other states, or shall have actual experience deemed by the city council to be equivalent to such registration. (2) The general contractor(s) and the subcontractor(s) shall possess a valid certificate of competency and occupational license, recognized and accepted under the laws of Florida and the ordinances of the city reffttlating the business of contracting, and where required, State of Florida registration as a contractor, or shall possess similar qualifications under the laws of other states, or shall have actual experience deemed by the city council to be equivalent to such certification. (3) The real estate person(s) shall be licensed under the laws of Florida licensing real estate brokers as either a broker or a salesman, or shall possess similar qualifications under the laws of other states, or shall have actual experience deemed by the city council to be equivalent to said licensing?-awd-~l~H-ha~et-a em,~t-~ ~d- ~~-Heea~e-i~stted-t~j~ -t4~-c~ty. (4) The businessperson(s) shall be actively engaged in any lawful business within the city and shall hold a current and valid occupational license issued by the city, or shall be an officer or employee of a business entity holding a current and valid occupational license issued by the city, or shall have actual experi- ence deemed b~' the city eounci.l to be ec~uivalent to su'c~ certification. (5) Each regular and alternate member of the board shall be a resident of the city. Section 2. That Section 2-104, "Codes enforcement board established", Subsection~canctes and reappointment' of the Code of Ordinances of the City of Delray Beach, Florida, be, and the same is hereby amended to read as follows: (d) Vacancies and reappointment. A member may be reappointed for one succes- sive ~rem-,tm.s~-t~-te~a-~~-eit~-eea~'tl teton. Appointments to fill any vacancy to the board shall be for the remainder of the unexpired term of office. Section 3. That should any section or provision of this ordinance or any portion thereof, a~y paragraph, sentence, or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 4. That all ordinances or pat-ts of ordinances which are in conflict herewith are hereby repealed. Section 5. That this ordinance shall become effective ten (10) days after its passage on Second and final reading.
