66-84 ORDINANCE NO. 66-84 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING SECTION 2 OF ORDINANCE NO. 64-8 3, WHICH ESTABLISHED AN SAD (SPECIAL ACTIVITIES DISTRICT) FOR PROPERTY LOCATED NORTH OF AVENUE "L ", BETWEEN FLORIDA BOULEVARD AND SOUTH FEDERAL HIGHWAY, BY ENACTING A NEW SUBSECTION (n} RELATIVE TO THE RESIDENTIAL PORTION OF THE SITE PLAN ALLOWING THE CONVERSION OF THE 16 DUPLEX STRUCTURES (32 UNITS) TO A 40 UNIT MULTIPLE FAMILY PROJECT BEING DEVELOPED IN ACCORDANCE WITH THE CONDITIONS LISTED IN PARAGRAPHS (a) THROUGH (m) OF ORDI- NANCE NO. 64-83, EXCEPT AS MODIFIED TO: (1) CHANGE THE PLAT NAME TO SOUTH DELRAY SHOPPING PLAZA, PHASE II, (2) APPROVAL OF WATER AND SEWER SYSTEM LAYOUT BY PUBLIC UTILITIES DEPARTMENT, AND (3) PROVIDING REQUIREMENTS FOR INTERIOR TREES; BY REPEALING SECTION 3 AND ENACTING A NEW SECTION 3 RELATIVE TO REDESIGNATING THE APPROVED SITE PLAN AND COMPLETION OF THE PROJECT IN ACCORDANCE WITH THE APPROVED SITE AND DEVELOPMENT PLANS; SAID LAND BEING ALL OF BLOCKS 29, 30, 31 AND 33 OF DEL-RATON PARK ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 14, PAGE 10, PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA; PROVIDING A SAVING CLAUSE; PROVIDING A GENERAL REPEALER; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Board, at the meeting held or~ July 16, 1984, recommended amending Ordinance No. 64-83 to modify the site plan for South Delray Shopping Plaza, Phase II (aka Tropic View Condomin- iums); and, WHEREAS, City Council has determined that such change should ~= made, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 2 of Ordinance No. 64-83 is hereby amended by adding a new paragraph (n) to read as follows: (n) That the residential portion of this site plan allowing the conversion of the 16 duplex structures (32 units) to a 40 unit multiple family project be developed in accordance with the conditions listed above (paragraphs (a) through (m), except as mod- ified by this paragraph: (1) Plat name will be South Delray Shopping Plaza, Phase II; (2)Layout of water and sewer system must be ap- proved by Public Utilities Department; (3) A minimum of 37 interior trees must be provided to be a minimum of twelve feet in height with a six foot spread and six feet of clear trunk. Section 2. That Section 3 of Ordinance No. 64-83 is hereby repealed and a new Section 3 is hereby enacted to read as follows: Section 3. That this project shall be completed in accordance with the approved site and development plans re: South Delray Shopping Plaza, Delray Beach, Florida, prepared by Joseph A. Chiesa, Architect, 1000 East Atlan- tic Boulevard, Suite 100, Pompano Beach, Florida, Sheet Nos. 2a, P1 and P2, dated June 25, 1983 and revised June 27, 1984; and prepared by James Santiago and Associates, 612 N.E. 14th Avenue, Fort Lauderdale, FL 33304, Sheet NO. L-1 dated July 1, 1983 and revised October 19, 1983, and Sheet Nos. L1 of 2 and L2 of 2 dated July 2, 1984~ and prepared by D.M. Ambrose Associates, Inc., 6190 North Federal Highway, Boca Raton, FL 33431, Sheet No. E-1 dated June 30, 1983 and revised July 27, 1983~ all of which are hereby incorporated by reference herein and made a part hereof and upon which the City has relied in granting this approval. Section 3. That should any section or provision of this ordi- nance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 4. That all ordinances or parts of ordinances in con- flict herewith be and the same are hereby repealed. Section 5. That this ordinance shall become effective ten days after passage on second and final reading.
