RESOLUTION NO. 85-17 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, VACATING AND ABANDONING A PORTION OF A 12' WIDE UTILITY EASEMENT; A PORTION OF A 22' WIDE UTILITY EASEMENT; A PORTION OF A 10' WIDE UTILITY EASEMENT; AND, A PORTION OF A SIDEWALK EASEMENT, AS MORE PARTICULARLY DESCRIBED IN EXHIBITS "A — D", AND DEDICATING A 12' WIDE UTILITY EASEMENT; A 12' WIDE SEWER EASEMENT; AND, A 12' WIDE WATER EASEMENT AS MORE PARTICULARLY DESCRIBED IN EXHIBITS "E — G", ASSOCIATED WITH THE REDEVELOPMENT OF DELRAY PLAZA (FKA LAVERS INTERNATIONAL PLAZA), LOCATED AT 660 WEST LINTON BOULEVARD, DELRAY BEACH, FLORIDA. WHEREAS, the City of Delray Beach, Florida received an application for the abandonment of a portion of a 12' wide utility easement dedicated via the Plat of "Laver's International Plaza Plat 2," as recorded in Plat Book 51, Page 3 of the Public Records of Palm Beach County, Florida, located at 660 West Linton Boulevard, and as more particularly described in Exhibit "A"; and WHEREAS, the City of Delray Beach, Florida received an application for the abandonment of a portion of a 22' wide utility easement dedicated via the Plat of "Laver's International Plaza Plat 1," as recorded in Plat Book 51, Page 1 of the Public Records of Palm Beach County, Florida, located at 660 West Linton Boulevard, and as more particularly described in Exhibit "B"; and WHEREAS, the City of Delray Beach, Florida received an application for the abandonment of a portion of a 10' wide utility easement as described in ORB 4637, Page 1303 of the Public Records of Palm Beach County, Florida, located at 660 West Linton Boulevard, and as more particularly described in Exhibit "C"; and WHEREAS, the City of Delray Beach, Florida received an application for the abandonment.of a portion of a sidewalk easement as described in ORB 13458, Page 1656 of the Public Records of Palm Beach County, Florida, located at 660 West Linton Boulevard, and as more particularly described in Exhibit "D"; and WHEREAS, the City of Delray Beach, Florida received an application for the dedication of a 12' wide utility easement, located at 660 West Linton Boulevard, and as more particularly described in Exhibit "E"; and WHEREAS, the City of Delray Beach, Florida received an application for the dedication of a 12' wide sewer easement, located at 660 West Linton Boulevard, and as more particularly described in Exhibit "F"; and WHEREAS, the City of Delray Beach, Florida received an application for the dedication of a 12' wide water easement, located at 660 West Linton Boulevard, and as more particularly described in Exhibit "G"; and WHEREAS, the application for abandonment of the easements was processed pursuant to Section 2.4.6(N), "Abandonment of Public Easements", of the Land Development Regulations of the City of Delray Beach, Florida; and WHEREAS, pursuant to LDR Section 2.4.6(N)(3)(c), the application was forwarded to the City Commission with the recommendation that the abandonments be approved, based upon positive findings; and WHEREAS, the City Commission of the City of Delray Beach, Florida, pursuant to LDR Section 2.4.6(N)(5), finds that the abandonments will not result in detriment for the provision of services to adjacent properties or the general area, that its interest in the described property is no longer needed for the public good and deems it to be in the best interest of the City of Delray Beach to vacate and abandon said easements, as more particularly described in Exhibits "A — D." NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, THAT: Section 1. The foregoing recitals are hereby incorporated herein by this reference. Section 2. Pursuant to Chapter 177 and Chapter 166 of the Florida Statutes,it is hereby determined to vacate and abandon all right and interest it holds to real property described in the following: A. A portion of a 12' wide utility easement dedicated via the Plat of"Laver's International Plaza Plat 2," as recorded in Plat Book 51, Page 3 of the Public Records of Palm Beach County, Florida, located at 660 West Linton Boulevard, and as more particularly described in Exhibit "A"; and B. A portion of a 22' wide utility easement dedicated via the Plat of"Laver's International Plaza Plat 1," as recorded in Plat Book 51, Page 1 of the Public Records of Palm Beach County, Florida, located at 660 West Linton Boulevard, and as more particularly described in Exhibit `B"; and 2 RES,NO. 85-17 C. A portion of a 10' wide utility easement as described in ORB 4637, Page 1303 of the Public Records of Palm Beach County, Florida, located at 660 West Linton Boulevard, and as more particularly described in Exhibit "C"; and D. A portion of a sidewalk easement as described in ORB 13458, Page 1656 of the L Public Records of Palm Beach County, Florida, located at 660 West Linton Boulevard, and as more particularly described in Exhibit "D". Section 3. The abandonment of the easements referenced in Exhibits "A" — "D" shall not be effective until the until both this Resolution and the replacement easements referenced in Exhibits "E" — "G" have been recorded in the Public Records of Palm Beach County, Florida.
