A Special Meeting of the City Commission of the City of Delray Beach, Florida, was called to
order by Mayor David Schmidt in the First Floor Conference Room at 6:00 p.m. on Tuesday,
September 12, 2000.
Roll call showed:

Commissioner Jeff Perlman

Absent - Commissioner Bill Schwartz
Also present were City Manager David T. Harden and City Attorney Susan A. Ruby.
Mayor Schmidt called the special meeting to order and announced that it had been called for the
purpose of considering the following item:

ORDINANCE NO. 26-00 (FIRST READING): An ordinance amending Chapter 33,
"Police and Fire Departments", subheading "Pensions", of the City Code to comply with
certain provisions of Chapter 99-1, Laws of Florida.
The City Attorney read the caption of the ordinance:
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF DELRAY
BEACH, FLORIDA, AMENDING CHAPTER 33, "POLICE AND FIRE
DEPARTMENTS", SUBHEADING "PENSIONS", OF THE CODE OF
ORDINANCES OF THE CITY OF DELRAY BEACH, BY AMENDING
SECTION 33.60, "DEFINITIONS", REVISING THE DEFINITION OF
AVERAGE MONTHLY EARNINGS; AMENDING SECTION 33.61,
"MEMBERSHIP; CONDITIONS OF ELIGIBILITY; APPLICATION",
PROVIDING FOR CHANGES IN BENEFICIARIES BY RETIREES;
AMENDING SECTION 33.62, "BENEFIT AMOUNTS AND ELIGIBILITY",
PROVIDING AN ADDITIONAL NORMAL RETIREMENT DATE,
PROVIDING FOR EARLY RETIREMENT AND REVISING THE
DISABILITY BENEFITS; AMENDING SECTION 33.63, "OPTIONAL
FORMS OF BENEFITS", TO PROVIDE ADDITIONAL BENEFIT OPTIONS;
AMENDING SECTION 33.64, "CONTRIBUTIONS", TO PROVIDE FOR
PAYMENT OF CITY CONTRIBUTIONS IN QUARTERLY INSTALLMENTS;
AMENDING SECTION 33.65, "ADMINISTRATION", TO CLARIFY THE
COMPOSITION OF THE BOARD OF TRUSTEES; AMENDING SECTION
33.66, "FINANCES AND FUND MANAGEMENT", REVISING CERTAIN
INVESTMENT POWERS OF THE BOARD OF TRUSTEES, AND
PROVIDING FOR THE EVALUATION OF MONEY MANAGERS;
CREATING A NEW SECTION 33.71, "SEPARATION FROM EMPLOYMENT
FOR MILITARY SERVICE"; PROVIDING A VALIDITY CLAUSE, AND
PROVIDING AN EFFECTIVE DATE.
The City Attorney stated that the proposed ordinance is necessary to bring the City's Police and
Fire pension plan into compliance with Chapter 99-1, Laws of Florida. A summary of the
proposed changes was included in the back-up information. According to a preliminary
statement from Stephen Palmquist, the plan's actuary, the changes do not have any monetary
impact although there will be an official actuarial statement provided by him. Adoption of the
ordinance is necessary by September 30, 2000 in order for the City to get the premium tax
monies due from the state. The City Attorney noted that the City reserves it's rights that the
statute impairs the City's contracts with the affected unions regarding extra benefits. She further
noted that the Police and Fire Board of Trustees is aware of the ordinance and will be discussing
it at their meeting on September 20, 2000.
Mrs. Archer moved to approve Ordinance No. 26-00 on FIRST Reading, seconded by Mr.
Perlman. Upon roll call the Commission voted as follows: Mr. Perlman - Yes; Mrs. Archer -
Yes; Ms. McCarthy - Yes; Mayor Schmidt - Yes. Said motion passed with a 4 to 0 vote.
There being no further business, Mayor Schmidt adjourned the special meeting at 6:06 p.m. at
which time the regularly scheduled workshop was convened.
