84-84 ORDINANCE NO. 84-84 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 9, 'BUILDINGS AND CON- STRUCTION", ARTICLE II, 'BUILDING CODE', OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING SECTION 9-17, 'AMENDMENTS AND ADDITIONS TO CODE", SUBSECTION i05.4(b), 'PLOT DIAGRAM', RELATIVE TO GRANTING A VARIANCE TO THE FLOOR ELEVATION OF LESS THAN 18' ABOVE THE CROWN OF THE ROAD BUT ABOVE THE 100 YEAR STORM OR NATIONAL INSURANCE MINIMUM ELEVATIONS UPON AP- PROVAL BY THE CITY ENGINEER OR ASSISTANT CITY ENGINEER; PROVIDING A SAVING CLAUSE; PROVIDING A GENERAL REPEALER; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Chapter 9, "Buildings and Construction', Article II, 'Building Code', Section 9-17, 'Amendments and Additions to Code', Subsection 105.4(b), 'Plot Diagram', of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended to read as follows: (b) Before slab inspection or prior to framing, the building department shall be supplied a certified sketch by a Florida registered land surveyor or a Florida registered engineer showing setback distances from each proeprty line to the stem walls or sills of the building or structure under construction. The building department shall be fur- nished by a Florida registered engineer or land surveyor, a certificate stating the fact that the floor slab is seven (7) feet above mean sea level measured to the top of the concrete slab which will be a minimum of eighteen (18) inches above the crown of the road or measured to the bottom of the wood joists which will be a minimum of eighteen (18) inches above the crown of the road. Should the property owner desire to set the floor elevation at less than 18' above the crown of the road~ but above the 100 year storm or National Insurance minimum elevations~ then a variance may be granted by the City Engineer or Assistant City Engineer providing the applicant provide a letter which is satisfac- tory to the City Engineer or Assistant City Engineer from an en~ineerin~ firm certifyin~ the drainage conditions have been investi~ated~ and the proposed floor elevation is above the floodin9 level. To determine whether the proposed floor =levation is above the floodin9 level~ it must be shown that the structure has adequate drainage to insure that floodin~ will not occur in a 100 year storm. No wall, however, shall be constructed which would exceed by over one foot the elevation of the floor slab before the stem wall survey has been submitted to the building department. Section 2. That should any section or provision of this ordi- nance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 3. That all ordinances or parts of ordinances in con- flict herewith be-~-nd the same are hereby repealed. Section 4. That this ordinance shall become effective ten days after passage on second and final reading.
