01-83 ORDINANCE NO. 1-83 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, CHANGING THE CITY'S LAND USE PLAN DESIG- NATION IN THE COMPREHENSIVE PLAN FOR A PARCEL OF LAND LOCATED IN SECTIONS 28 AND 29, TOWNSHIP 46 SOUTH, RANGE 43 EAST, FROM MF-10 MULTIPLE FAMILY (10 UNITS PER. ACRE) TO MF-6 MULTIPLE FAMILY (6 UNITS PER ACRE); AMENDING THE LAND USE PLAN; PROVIDING AN EFFECTIVE DATE.' %~HEREAS, the Planning and Zoning Board, at the meeting held on October 18, 1982, unanimously recommended that the City's Land Use Plan designation in the Comprehensive Plan for the subject property be changed from MF-10 Multiple Family to MF-6 Multiple Family; and, %~ER~AS, the City Council concurs in the recommendation, NO%~, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TIIE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the legal description of the subject property is as follows: A parcel of land located in Del-Raton Park, a Subdivision as recorded in Plat Book 14, Pages 9 and 10, of the Palm Beach County Records, more particularly described as follows: The right-of-way of Avenue F East of the Northerly prolonga- tion of Lots 1 thru 10 of Block 24, of said Subdivision; together with the right-of-way of Frederick Boulevard South of the Easterly prolongation of the South line of Lot 11, Block 23, to the Easterly prolongation of the North line of Lot 25, Block 27; together with the right-of-way of Avenue G East of the Northerly prolongation of the East line of Lots 1 thru 9, Block 13; together with the right-of-way of LaMat Avenue, East of the Northerly prolongation of the East line of Lots 1 thru 9, Block 12 to the West right-of-way of Florida Boulevard; together with Avenue H, East of the Northerly prolongation of Lots 1 thru 10, Block 27; together with the West half of the right-of-way of Florida Boulevard South of the North line of Lot 56, and North of the North line of Lot 47, Block 35, also south of South line of Lot 45, Block 35 and North of the South line of Lot 58, Block 34; together with Lots i1 thru 24, Block 24, together with Lots 10 thru 27, Block 25, together with Lots 11 thru 33, Block 26; together with Lots 26 thru 38, Block 27; together with Lots 1 thru 11, 58 thru 68, Block 34, together with Lots 11 thru 44, 48 thru 56, Block 35; together with all included alleys. A parcel of land located in Del Raton Park, a Subdivision as recorded in Plat Book 14, Pages 9 and I0, of the Palm Beach County Records, more particularly described as follows: The right-of-way of Avenue J, East of a Northerly prolonga- tion of Lots 1 thru 10, Block 29 to the Northerly prolonga- tion of the centerline of the North-South alley between Lots 24 and 35 and 25 thru 34, Block 29; Together with the South ri[~ht-of-way of said Avenue J East of said North-South Alley to the %~est right-of-way line of Florida Boulevard; Tocether witl~ the %$est right-of-way of Florida Boulevard South of the centerline of Avenue J and North of the centerline of Avenue L; cogether with the right-of-way of Avenue K East cf the Northerly prolongation of Lots 1 thru 17, !~lock 30 to the Uest right-of-way line of Frederick Boulevard; together with all the right-of-way of Kings Court; together with the rlght-of-way of Avenue L, East of the Hortherly prolongation of the East line of Lot 44, Block 32 to the centerline of Frederick Boulevard; also the South half of said Avenue L East of said centerline of Frederick Boulevard to the West right-of-way line of Florida Boulevard; together with the Right-of-way of Frederick Boulevard South of the Centerline of Avenue J to the centerline of Avenue L; also the West half of said Frederick Boulevard South of the said center- line of Avenue L to the platted south line of Frederick Boulevard; together with Lots 11 thru 22, Block 28; together with Lots 11 thru 46, Block 29; together with Lots 18 thru 39, Block 30; together with all of Block 31; together with Lots 45 thru 68, Block 32; together with all of Block 33; together with all inclusive alleys. Section 2. That the Land Use Plan designation of the subject property in the Comprehensive Plan adopted by Ordinance Mo. 65-79 is hereby changed to MF-6 ~iultiple Family. Section 3. That the Planning Director of the City of Delray Beach shall, upon the effective date of this ordinance, change the Land Use Plan of Delray Beach, Florida, to conform with the provisions hereof. Section 4. That this ordinance shall become effective ten days after passage on second and final reading.
