02-83 ORDINANCE ~O. 2-83 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, CHANGING THE CITY'S LAND USE PLAN DESIG- NATION IN THE COMPREHENSIVE PLAN FOR A PARCEL OF LAND LOCATED IN SECTIONS 28, 29 AND 32, TOWNSHIP 46 SOUTH, RANGE 43 EAST, FROM MF-10 MULTIPLE FAMILY (10 UNITS PER ACRE) TO C-COMMERCIAL; AMENDING THE LAND USE PLAN; PRO- VIDING AN EFFECTIVE DATE. ;~HEREAS, the Planning and Zoning Board, at the meeting held on October 18, 1982, unanimously recommended that the City's Land Use Plan designation in the Comprehensive Plan for the subject property be changed from MF-10 Multiple Family to C-Commercial; and, ;~HEREAS, the City Council concurs in the recommendation, NOd, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the legal description of the subject property is as follows: A parcel of land located in Del-Raton Park, a Subdivision as recorded in Plat Book 14, Pages 9 and 10, of the Palm Beach County Records, more particularly described as follows: That portion of Del Raton Park bounded on the North by the centerline of LaMat Avenue; bounded on the West by the East right-of-way of F.E.C. R.R.; bounded on the South by the North right-of-way of the C-15 Canal; Bounded on the East by the Centerline of Del Raton Boule- vard (U.S. Hwy. ~1); less that portion known as Tropic Palms, Plat No. 1, as recorded in Plat Book 25, Page 100 of the Palm Beach County Records; also less that portion of Dixie Highway South of the North line of said Tropic Palms; together with that portion of Del Raton Park bounded on the North by the North right-of-way of Avenue F; Bounded on the West by the centerline of said Del Raton Boulevard; bounded on the South by a line parallel with and 323.S2 feet South of the North section line of Sectzon 32, Township 46 South, Range 43 East, as noted on Tropic Isle Harbor Shopping Center, as recorded in Plat Book 25, Page 77, of the Palm Beach County Records; bounded on the East by the Northerly extension of the East line of Lot 17, Block 30, of said Del Raton Park, between said North line of Section 32, and said Avenue F; less Lots 6 thru ~0, Block 27, and Lots 1 thru 5, Block 28, of said Del Raton Park, and the East half of Del Raton Boulevard ad3acent to the said Lots of Blocks 27 and 28. Section 2. That the Land Use Plan designation of the subject Froperty in the Comprehensive Plan adopted by Ordinance No. 65-79 is h~rebl, changed to C-Commercial. Section 3. Thet the Planning Director of the City of Delray ~each snall, upon the effective date of this ordinance, change the Land Use Plan of Delray Beach, Florida, to conform with the provisions hereof. Section 4. That this ordinance shall become effective ten days after passage on second and final reading.
