13-83 ORDINANCE NO. 13-83 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 9 "BUILDINGS AND CON- STRUCTION", ARTICLE X "LANDSCAPING", OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING SECTION 9-374(f), "ACCESSWAYS", TO REQUIRE THAT ACCESSWAYS FOR GASOLINE STATIONS SHALL BE GOVERNED BY SEC. 30-17(O)(13) OF THE ZONING CODE; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Chapter 9, "Buildings and Construction, Article X, "Landscaping", Section 9-374(f) "Accessways" of the Code of Ordinances of the City of Delray Beach, Florida, is hereby amended to read as fol- lows: (f) Accessways. The maximum width of an accessway through the perimeter landscaped strip to an off-street parking or other vehicular use area shall be twenty-four (24) feet for two-way vehicular movement and twelve (12) feet for one-way vehicular movement. No more than one two-way accessway shall be permitted for any street frontage up to one hundred (100) lineal feet or no more than two (2) one-way accessways shall be permitted for any street frontage up to one hundred (100) lineal feet, such stand- ards to be applicable to any property under one ownership. Where such ownership involves over one hundred (100) feet of street frontage, one additional two-way or two (2) additional one-way drives may be permitted for each addi- tional one hundred (100) feet of frontage or major frac- tion thereof. Accessways for gasoline stations shall be governed by Sec. 30-17(0)(13) of the Zoning Code. The balance of each street frontage not involved with access- ways shall be landscaped in accordance with the provisions of this article. Section 2. That should any section or provision of this ordi- nance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 3. That this ordinance shall become effective ten days after passage on second and final reading.
