19-83 ORDINANCE NO. 19-83 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AMENDING CHAPTER 30 "ZONING" OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY BEACH, FLORIDA, BY AMENDING SECTION 30-10 "CC (COMMUNITY COMMERCIAL DIS- TRICT)" (I) "PARKING AND LOADING REGULATIONS", BY ESTAB- LISHING REQUIRED PARKING SPACES FOR SHOPPING CENTERS OF UP TO 400,000 SQUARE FEET AT 4.0 SPACES PER 1,000 SQUARE FEET OF GROSS LEASABLE FLOOR AREA AND FOR SHOPPING CEN- TERS FROM 400,001 SQUARE FEET THROUGH 600,000 SQUARE FEET AT 4.5 SPACES PER 1,000 SQUARE FEET OF GROSS LEASABLE FLOOR AREA; PROVIDING FOR CLARIFICATION OF WHAT CON- STITUTES A SHOPPING CENTER FOR PURPOSES OF THESE REGU- LATIONS AND FURTHER TECHNICAL CLARIFICATIONS; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That Section 30-10 "CC (Community Commercial Dis- trict)" (I) "Parking and Loading Regulations" of the Code Of Ordinances of the City of Delray Beach, Florida, is hereby amended to read as follows: (I) PARKING AND LOADING REGULATIONS The number of parking spaces required for shopping cen- ters having a ~ross leasable floor area up to 400,000 sq. ft. shall be ~ 4.0 spaces per 1,000 square feet of gross leasable area; shopping centers having a gross leasable floor area between 400,001 sq. ft. and 600,000 sq. ft. shall provide 4.5 spaces per 1,000 square feet of ~ross leasable area. These standards only apply to uses incorporated into a central mall shopping cente~. ~ener- ally understood to consist of one or two main structures housing multiple retail~ food~ and office uses. Iso- lated, free~standin~ structures dedicated to one or two activities shall comply with the ~rkin~ standards as es- tablished at Sec. 30-18. ~e% In all other respects, the provisions of Sec. 30-18 and Sec. 30-19 shall apply in this zoning district. Section 2. That should any section or provision of this ordi- nance or any portion thereof, any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the part declared to be invalid. Section 3. That this ordinance shall become effective ten days after passage on second and final reading.
