REGIONAL PLANNING COUNCIL TO CREATE A MASTER
PLAN AND FORM- BASED CODE FOR THE CONGRESS

To apply a form-based code to the Congress Avenue corridor, the community must
first decide what kind of place the code is meant to achieve. Although a form-based
code regulates use to an extent, it primarily regulates building form and placement
through specifying the types of buildings that are appropriate to a given street or
neighborhood. A public charrette will be utilized to ascertain the community's vision
for the area and form the basis for development of a master plan for the overall
corridor and concept plans for individual projects within the corridor. A form-based
code will then be created, which in essence becomes a blueprint for making the
shared vision a reality.
Attached is the scope of work and proposed fees for the creation of a Congress
Avenue Master Plan and related Form-Based Code by the Treasure Coast Regional
Planning Council. The Congress Avenue Master Plan is expected to take
approximately six weeks after the execution of the contract and the related form-
based code will take an additional 8 weeks after acceptance of the Master Plan. The
total cost for the Master Plan of the entire three mile corridor is $85,000 and the fee
for the form-based code is $125,000, for a total of $210,000. The funds for these
tasks are to taken from the City Manager's contingency fund.
RECOMMENDED ACTION
By motion, approve the scope of services and proposed fees to create both a
Congress Avenue Master Plan and related Form-Based code.

Subject: Proposal to Provide a Master Plan and Form-Based Code for the Congress
Avenue Area
Dear Mr. Harden:
Thank you for considering the Treasure Coast Regional Planning Council (TCRPC) to
provide the City with a Form-Based Code for a three-mile stretch of Congress Avenue
and adjacent properties. In order to provide the City with a Form-Based Code, it is
necessary to first develop a detailed Master Plan for the area, from which the Code then
derives. Council is submitting this proposed agreement setting forth a draft scope of
services together with a proposed fee to perform such services. These services include the
preparation of a Master Plan for the area, as well as development of the corresponding
From Based Code.
If you have any questions or wish to further refine the suggested scope of services, please
contact staff at your earliest convenience. However, if the agreement meets with the
City's approval, Council will schedule the planning activities to begin in August 2006. In
that case, please sign it in the space provided and return a signed copy to Council.
I. SCOPE AND SCHEDULE
Con!!ress Avenue Master Plan
A. TCRPC will assist the City with the creation of a conceptual Master Plan for a
three-mile stretch of the Congress Avenue corridor during a week-long charrette
starting Monday, (date TBD). TCRPC will perform the professional services
described in this agreement by working at facilities in or near the study area and
at Council offices in Stuart. Council has created a budget based on performing
certain tasks and suggested a work schedule for completing these tasks as follows:
Week 1: Receive from client (City of Delray Beach) a fully detailed base map
and relevant plans and reports (see Attachment A: City to Provide); attend one
initial client meeting to discuss the charrette; commence preliminary logistical
planning.
Week 2-4: Establish a Charrette Steering Committee, and request from the City
additional site information, as needed.
Week 4-5: Conduct a series of public meetings with the Charrette Steering
Committee members. Conduct a series of 30-minute interviews with City
representatives, business and property owners, elected officials and
representatives of institutions that will be involved/affected in the study area.
Review supplemental project information; finalize charrette logistics.
Week 6: Arrive with an 8 to 10 person design team. Conduct a seven-day public
charrette that consists of: a) a kick-off presentation to City and citizens; b) a
design workshop in an appropriate format to reveal design issues and generate
design ideas (the ratio of consultants to workshop participants at table sessions
shall be no greater than 1: 10, with one roaming presenter and City staff providing
assistance upon request); c) a presentation of design ideas by the public, d) six
days of design to create, refine, and illustrate an overall Master Plan for the study
area as well as a conceptual plan for each project within the study area, with one
or more explanatory sketches and diagrams, as appropriate; d) a presentation of
the resulting Master Plan to City and residents.
* At all presentations, the City shall provide an appropriate auditorium with the required
audio (sound system) and visual (8' x 8' screen) equipment.
Cone:ress Avenue Form Based Code
Upon acceptance of the Master Plan by the City Commission, work on the Form Based
Code will begin.
Week 7-15: Develop a Form-Based Code for the area which will include the
following:
a) building placement
b) building height
c) building size and type
d) parking placement
e) parking height
f) parking quantities
g) mix of uses
h) public open space
i) street sections

j) density
Week 16: Presentation of Form Based Code to City and residents.
II. FINAL WORK PRODUCTS
A. Deliverables: TCRPC shall provide the City with the following deliverables as
final work products:
1. Conceptual Master Plan (1) for the study area, rendered III color at an
appropriate scale and suitable for publication.
2. Form-Based Code
3. Perspective sketches or diagrams (as many as needed) illustrating significant
plan features or explaining design ideas consistent with the respective plan.
Each sketch or diagram will be rendered in color or black and white, at an
appropriate size, and suitable for publication.
4. Street Sections: (as many as needed) illustrating in diagrammatic form the
relationships among the various elements within, and adjacent to the right of
way. Each section will be rendered in color or black and white, at an
appropriate size, and suitable for publication.
5. PowerPoint Presentations: All presentations (kick-off, work-in-progress, final)
will be available in PowerPoint format immediately after they are presented.
6. Any changes to the City's comprehensive plan, or any other changes
necessary for the implementation of the charrette Master Plan or the resulting
form-based code are not part of this contract. The city can decide to contract
with TCRPC for Master Plan implementation at a later date.
B. Format of Deliverables: TCRPC shall provide the City with final work products
in the following format:
1. TCRPC shall print written documents (1 copy only) on paper, as appropriate,
and shall also provide digital copy of such documents in an appropriate format
(QuarkXpress or pdt).
2. TCRPC shall provide graphic documents, including drawings, diagrams,
maps, perspective renderings, or other comparable materials (1 copy only) on
paper, as appropriate, and in a digital format suitable for reproduction.

3. TCRPC shall provide the City with a digital copy of all the PowerPoint
presentations used for this project.
4. The City may request additional copies of deliverables upon payment to
TCRPC of the actual reproduction cost.
IV. FEES AND REIMBURSABLE EXPENSES

A. Fees: Professional services described in this proposal will be performed for a
fixed fee in the amount of $ 85,000.00. This includes travel, out of pocket
expenses (printing and reproduction costs) film processing, mail, couriers, and
other costs related to the professional services we are providing. It does not
include refreshments provided to the general public during the public events, nor
does it include any rental expense for public space (for the occasion when the
public is gathered), should that be necessary.
B. Payment Schedule: The City shall pay the fees to TCRPC according to the
following schedule:
$ 21,250.00 Twenty five percent (25%) of the professional fees two weeks
prior to the charrette.
$ 21,250.00 Twenty five percent (25%) of the professional at the end of the
seven-day charrette
$ 42,500.00 Fifty percent (50%) the remammg balance, upon conceptual
approval of the Master Plan, prior to commencement of work on
the Form Based Code.

C. Fees: Professional services described in this proposal will be performed for a
fixed fee in the amount of $ 125,000.00. This includes travel, out of pocket

D. Payment Schedule: The City shall pay the fees to TCRPC according to the
following schedule:
$ 31,250.00 Twenty five percent (25%) of the professional fees at conceptual
approval of Master Plan.
$ 62,500.00
Fifty percent (50%) of the professional after presentation of Form
Based Code to City and residents.
$ 31,250.00
Twenty five percent (25%) the remaining balance, upon adoption
of the Form Based Code by the City Commission.
