AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH,
FLORIDA, AMENDING CHAPTER 14, "JUNK, JUNKYARDS AND AUTOMOTIVE
REPAIRS", ARTICLE 1/"JUNKYARDS", BY REPEALING SECTION 14-14, "DEFINITIONS",
AND ENACTING A NEW SECTION 14-14, "DEFINITIONS", TO PROVIDE, FOR THE
PURPOSES OF ARTICLE II, DEFINITIONS OF AUTOMOBILE GRAVEYARD, JUNK, AND
JUNKYARD; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 14, "JUNK, JUNKYARDS AND AUTOMOTIVE REPAIRS", Article II,
"JUNKYARDS", Section 14-14, "Definitions", of the Code of Ordinances of the City of Delray Beach,
Florida, is hereby repealed and a new Section 14-14, "Definitions", be, and the same is hereby enacted
to read as follows:
Sec. 14-14. Definitions.
For the purposes of this Article, the following definitions shall apply:
(a) Automobile graveyard shall mean an establishment or place of business which is maintained
or operated for the use of storing, keeping, buying or selling wrecked, scrapped, ruined, or dismantled
motor vehicles or motor vehicle parts; provided, however, that this definition does not include nor
apply to businesses which solely sell automotive parts and accessories.
(b) Junk shall mean any item, including but not limited to dilapidated furniture, appliance,
machinery, equipment, building material, automobile parts, tires, or other items which are either in a
wholly or partially rusted, wrecked, junked, dismantled, or inoperative condition; provided, however,
that this definition does not include nor apply to businesses which solely sell automotive parts and
accessories.
(c) Junkyard shall mean an establishment or place of business which is maintained or operated
for the use of storing, keeping, buying or selling such junk, or for the maintenance or operation of an
automobile graveyard.
Section 2. That should any section or provision of this ordinance or any portion thereof, any
paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as a whole or part thereof other than the
part declared to be invalid.
Section 3. That this ordinance shall become effective ten (10) days after passage on second and
final reading.
