AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY
BEACH, FLORIDA, ZONING AND PLACING LAND WHICH IS PRES-
ENTLY ZONED R-1AAA-B (SINGLE FAMILY DWELLING) DISTRICT,
IN PART, and R-1AA (SINGLE FAMILY DWELLING) DISTRICT, IN
PART, IN SAD (SPECIAL ACTIVITIES) DISTRICT, BEING A 4.965
ACRE PARCEL OF LAND, LOCATED EAST OF MILITARY TRAIL,
BETWEEN LINTON BOULEVARD AND SHERWOOD BOULEVARD, SAID
LAND BEING IN SECTION 24, TOWNSHIP 46 SOUTH, RANGE 42
EAST; GRANTING CONDITIONAL USE A~D SITE AND DEVELOPMENT
PLAN APPROVAL AND AMENDING "ZONING MAP OF DELRAY BEACH,
FLORIDA, 1983".
WHEREAS, the Planning and Zoning Board, at the meeting held on
May 16, 1983, recommended rezoning and placing land presently zoned
R-LAAA-B (Single Family Dwelling) District, in part and R-1AA (Single
Family Dwelling) District in part, in SAD (Special Activities) District,
with certain express conditions; and,
WHEREAS, the City Council has determined that such change should
be m~de,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRA~ BEACH, FLORIDA, AS FOLLOWS:
Section 1. That the following described property in the City of
Delray Beach, Florida, is hereby rezoned and placed in the SAD (Special
Activities) District as defined in Chapter 30 of the Code of Ordinances of
the City of Delray Beach, Florida, to-wit:
The East 721 feet of the West 776 feet of the South 300
feet of the North 1895 feet of the Southwest % of Section
24, Township 46 South, Range 42 East, Palm Beach County,
Florida; Subject to easements and rights-of-way of record.
Section 2. That conditional use and site and development plan
approvals for the subject property described in Section 1, above, are
hereby granted subject to the following expressed conditions:
(a) The only conditional use to be permitted hereunder is as
fo 11 ows:
Church Conference Center with dormitories, chapel, con-
ference rooms and administrative offices.
(b) That all signs and pavement markings constructed or erected
by the developer must be in accordance with MUTCD specifica-
tions.
(c) The drainage of the subject project shall be maintained on
site or out through the storm sewer system and no drainage
will be allowed to flow over land onto adjacent property.
(d) There will be no dumpsters, cluster boxes, trees, shrubs or
structures permitted on any easements or rights-of-way shown
on the plat.
(e) This approval is subject to the requirement that all irriga-
tion for this project shall be from a source other than City
water, if such water is suitable for irrigation.
(f) That prior to the issuance of any building permits the
developer and/or owner shall deed additional right-of-way
for Military Trail to Palm Beach County.
(g) That the developer shall submit a traffic impact analysis
addressing the need for a left turn lane on Military Trail
and if a turn lane is required, as shown by such analysis,
then prior to the issuance of any certificates of occupancy,
it shall be designed and constructed by the developer at the
developer's sole expense, to fit in with Palm Beach County's
existing plans to 4-lane Military Trail.
(h) That prior to the issuance of any building permits the
developer shall submit topography 50 feet off-site to the
north and east.
(i) That the garbage container location shall be clearly deline-
ated on the site plan in accordance with the approval of the
Superintendent of Sanitation.
(j) That the additional parking shown on the site plan shall be
constructed of stabilized sod.
(k) That the developer shall install at their sole expense,
complete automatic fire sprinkler system to all buildings.
(1) That the proposed sanitary sewer size shall be not less than
8" diameter with minimum acceptable grade to assure 2 ft./
second gravity flow. All changes in alignment 45° and
greater shall be accomplished with manholes to facilitate
good flow conditions. Cleanouts shall be provided according
to the City Building Code.
(m) That the developer shall pay to the appropriate party all
allocable charges for water service line hook-up.
Section 3. That the development of this site be in accordance
with the approved site and development plans re: The James L. Duncan
Center For Continuing Education, Delray Beach, Florida, prepared by Pea-
cock & Lewis, Architects and Planners, Inc., 501 South Flagler Drive,
Suite 500, WeSt Palm Beach, FL 33401, Sheet Nos. 1-13, dated May 2, 1983;
all of which are incorporated by reference and made a part hereof and upon
which the City has relied in granting this approval.
Section 4. That the time limitation of this approval pursuant to
Sections 30-21(E) and 30-22(E) of the Zoning Code shall be eighteen (18)
men,is from the effective date of this ordinance.
Section 5. That the Planning Director of said City shall, upon
the effective date of this ordinance change the Zoning Map of Delray
Beach, Florida, to conform with the provisions of Section 1, hereof.
Section 6. That any building permits issued by the City shall be
subject to substantial construction, consisting of footings and slabs as a
minimum, being accomplished by the developer within 120 days of building
permit issuance, otherwise said building permits to be null and void in
the absence of the aforesaid construction progress.
Section 7. That this ordinance shall become effective ten days
after passage on second and final reading.
