AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRA~
BEACH, FLORIDA, AMENDING SECTION l(a) OF ORDINANCE NO.
15-81, WHICH AMENDED ORDINANCE NO. 6-81 RELATIVE TO
ESTABLISHING SAD (SPECIAL ACTIVITIES DISTRICT) FOR PROP-
ERTY LOCATED ON THE WEST SIDE OF U.S. ~1, BETWEEN LINTON
BOULEVARD AND S.E. 10TH STREET IN SECTION 21, TOWNSHIP 46
SOUTH, RANGE 43 EAST, TO PROVIDE FOR ADDITIONAL CONDI-
TIONAL USES IN SUCH SAD; PROVIDING A SAVING CLAUSE;
PROVIDING AN. EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Board, at the meeting held on
June 20, 1983, recommended amending Ordinance No. 15-81 to allow an ex-
pansion of permitted uses for the Professional Office Plaza for Acquilano,
an existing office building; and,
WHEREAS., the City Council has determined that such cha.nge shoul~
be made,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Section l(a) of Ordinance No. 15-81 is hereby
amended to read as follows:
(a) The only conditional uses to be permitted hereunder are
as follows:
( 1 ) Accountants
(2) Attorneys.
( 3 ) Architects
(4) Certified Appraisers. ~
( 5 ) Dentists
( 6 ) Engineers
(7) Laboratories (as accessory use to Dental or
Physicians office)
(8) Land Planners
( 9 ) Opticians
(10) Computer Data Services
(11) General Investments
(12) Insurance Agencies
( 13 ) Management Consul rants
(14) Marketing Consultants
(15) Mortgage Brokerage
(16) Real Estate
(17) Secretarial Services
(18) Stock Brokerage
(19) Tax Return Services
(20) Title Agencies
(~.2.1) Health care services~ including but not limited to
Dhysiciansr sur~.e0ns r chiropractors, optom.etrists,
and physical therapists; and inclu.din~ 0ut-Ratient
surgical facilities for the same; providing; how-
ever r that this facility will not be operated as a
24 hour~ acute-care center.
(22) Commercial banks and savings and loan associations
with no drive-through facilities.
(23) Interior Designers and decorators with no furniture
showrooms.
(24) Pharmaceutical and optical center for prescription
drugs, 9rescription eyeglasses, surgical supplies,
and over-the-counter drugs only.
Section 2. That should any section or provision of this ordi-
nance or any portion thereof, any paragraph, sentence, or word be declared
by a Court of competent jurisdiction to be invalid, such decision shall
not affect the validity of the remainder hereof as a whole or part thereof
other than the part declared to be invalid.
Section 3. That this ordinance shall become effective ten .days
afte= passage on second and final reading.
