62-83 ORDINANCE NO. 62-83 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ZONING AND PLACING LAND WHICH IS PRES- ENTLY ZONED RM-10 (MULTIPLE FAMILY DWELLING) DISTRICT, IN SAD (SPECIAL ACTIVITIES) DISTRICT, BEING A' 1.44 ACRE PARCEL OF LAND LOCATED SOUTH OF LAKE IDA ROAD, BETWEEN CONGRESS AVENUE AND DAVIS ROAD, SAID LAND BEING IN SEC- TION 7, TOWNSHIP 46 SOUTH, RANGE 43 EAST, GRANTING CON- DITIONAL USE AND SITE AND DEVELOPMENT PLAN APPROVAL AND AMENDING "ZONING MAP OF DELRAY BEACH, FLORIDA, 1983". WHEREAS, the Planning and Zoning Board, at the meeting held on July 18, 1983, unanimously recommended rezoning and placing land presently zoned ~4-10 (Multiple Family Dwelling) District, in SAD (Special Acti- vities) District, with certain expressed conditions; and, ~HEREAS, the City Council has determined that such change should be made, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the following described property in the City of Delray Beach, Florida, is hereby rezoned and placed in the SAD (Special Activities) District as defined in Chapter 30 of the Code'of Ordinances of the City of Delray Beach, Florida, to-wit: McCulloch Plat No 1 as recorded in Plat Book 45, Page 31 of the Public Records of Palm Beach County, Florida. Being a replat of Lots 1 to 7 inclusive, Block 1, Delray Shores as recorded in Plat Book 24, Pages 232 and 233 of the Public Records of Palm Beach County, Florida, City of Delray Beach. This property is located at 2100 and 2150 Lake Ida Road. The above-described parcel contains a 1.44 acre parcel of land, more or less Section 2. That conditional use and site and development plan approvals for the subject property described in Section 1, above, are hereby granted subject to the following expressed conditions: (a) The only conditional uses to be permitted, hereunder are as follows: Doctors Dentists ~ Lawyers Accountants Architects Engineers Insurance Agencies Title/Abstract Companies ~eal Estate Agency. Computer Services,. providing no repair or retail Surveyor/Land Planner Management Companies Financial Services Medical Arts Pharmacy Advertising Agency Travel Agency Appraisers Association Offices: Medical Dental Trade Professional Consultants Clergy Clinics Executive Offices; Corporate Employment Agencies Manufacturer Representatives Investment Advisory Service Mortgage Brokers Physical Therapy Center Court Reporters Secretarial Services Chiropracters Independent Trustees Landscape Architects Naturopaths Opticians Optometrists Osteopaths Physicians Podiatrists Psychologists Surgeons Radiologists (b) Prior to development of this propertY and receiving any building permits therefore, the subject development is required to meet the platting requirements set forth in the City's Subdivision Ordinances, Chapter 24 of the Code ! of Ordinances. ( c ) That al 1 signs and pavement marking s constructed or erected by the developer must be in accordance with MUTCD · ! specifications. (d) The drainage of the subject project shall be maintained on site or out through the storm sewer system and no drainage will be allowed to flow over land onto adjacent property. (e) There shall be no dumpsters, cluster boxes, trees, shrubs or structures permitted on any easements or rights-of-way shown on the plat. (f) This approval is subject to ~e '~equirement that all irrigation for this project shall be from a source other than City water, if such water is suitable for irriga- tion. (g) The developer shall at his sole expense construct a sidewalk along Lake ~da Road, in accordance with the requirements, if any,. of the appropriate governmental bodies. (h) That, prior to issuance of any building permits, the developer shall submit the topographic conditions of the subject property and for 100' off-site. (i) That, prior to issuance of any building permits, the developer shall submit a tree survey to the City. - 2 - Ord. No. 62-83 Section 3. That the development of the property described in Section i is to be in accordance with the approved site and development plans re: Delray Shores Professional Plaza, Lake Ida Road, Delray Beach, Florida, prepared by McCulloch Construction Company, 1885 N.W. 9th Street, Delray Beach, Florida 33445, Sheet No. D-l, dated 1/15/82, revised 5/12/82, and Sheet No. D-2, dated 2/20/82; all of wh.ich are incorporated by reference and made a part hereof and upon which the City has relied in granting this approval. Section 4. That the time limitation of this approval pursuant to Section 30-21(E) and 30-22(E) of the Zoning Code .shall be twelve (12) months from the effective date of this ordinance. Section 5. That the Planning Director of said City shall, upon the effective date of this ordinance change the Zoning Map of Delray~ Beach, Florida, to conform with the provisions of Section 1, hereof. Section 6. That any building permits issued by the City shall be subject to substantial construction, consisting of footings and slabs as a! minimum, being accomplished by the developer within 120 days of building! permit issuance, otherwise said building permits to be null and void in. the absence of the aforesaid construction progress. Section 7. That this ordinance shall become effective ten days. after passage on second and final reading.
