AN ORDINANCE OF THE CITY COUNCIL OF THF. CITY OF D~.LRAY
BEACH, FLORIDA, ANNEXING TO THE CITY OF DELRAY BEACH A
PARCEL OF .LAND LYING IN SECTION 28, TOW]~SHIP 46 SOUTH,
RANGE 43 EAST, BEING ~DRE FULLY DESCRIBED BELOW, WHICH
LAND IS CONTIGUOUS TO EXISTING MUNICIPAL LIMITS OF SA_ID
CITY; PROVIDING FOR THE RIGHTS AND OBLIGATIONS OF SAID
LAND; PROVIDING FOR THK ZONING THEREOF.
WHEREAS, ~bert H. Wiebelt, Trustee, (U/A dated ~aroh 21, 1979,
the Robert H. Wiebelt Revocable Living Trust), is the fee-simple owner of
the proper~y hereinafter described; and,
WHEREAS, Robert H. Wiebelt, Trustee, (U/A dated 5~rch 21, 1979,
the Robert H. Wiebelt Revocable Living Trust), has requested Uy bis peti-
tion to have the property annexed into the municipal limits of the City of
Delray Beach; and,
WHEREAS, the designation of a zoning classification is part of
the annexation proceeding, the City Council has determined that the pro-
ced=res set forth in Section 30-23 of the Zoning Code, which applies to
property already in the City limits, shall not be applicable in annexation
proceedings; and,
WHEREAS, the City of Delray Beach has heretofore been authorized
to annex lands in accordance with Section 171.044 of the Florida Statutes,
NOW, THEREFORE, BW. IT ORDAINED BY TH~. CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
SeCti?n !..'. That the City Council of the City of Delray Beach,
Palm Beach County, Florida, hereby annexes to said City the followin9
described land located in Palm Beach County, Florida, which lies contigu-
ous to said City to-wit:
That portion of Lot 2, lying east of the east right-of-way line
of U.S. Route 1 plus all of Lot 3 of Block 21 plus that portion
of Lots 1 thru 11, inclusive, lying east of the. east right-of-way
line of U.S. Route 1 and all of Lots 34 tb_ru 44 of Block 22, plus
all of Lots 1 thru 11, inclusive, of Block 36, plus all of Lots
19 thru 23, inclusive, of Block 37, plus tha= portion oX Avenue
"C" lying between and adjacent to said lots vacated by Official
Record Book 1765 at Page 547 of Palm Be~ch County Public Records,
plus that portion of Frederick Boulevard lying between and adja-
cent to the' aforesaid lots and vacated by Official Record Book
1765 at Page 547 and by Official Record Book 1153 at Page 318-319
of the Public Records of Palm Beach County, all of the above
being and lying in DEL RATON PARK Subdivision, as the same is
recorded in Plat Book 14 at Page 9 of the Public kecords of Palm
Beach County, Florida, and being more fully described as follows:
Begin at the Southeast corner of Lot 11, Block 36; thence run
west along the southerly boundary of said Lot 11 and of Lot 34,
Block 22; 258.95 feet to the southwest corner of Lot 34 being
also the southeast corner of Lot 11, Block 22; thence north-
westerly along the southerly boundary of Lot 11, wi~h an include~
angle of 168°54'15", measured east to north from the previous
course, 46.39 feet to a point of intersection with the afore-
mentioned easterly right-of-way line of U.S. Route 1; thence run
Northeasterly along said east right-of-way line, wit~ an included
angle of 90°00' 00", 450.00 feet to a point on the nor~_~erly
boundary of Lot 2, Block 21; thence run southeasterly along said
north boundary with an included an~le of 90°00'00", 2.59 feet to
the northeast corner of said Lot 2, being also the northwest
corner of Lot 3, Block 21, thence run east with an included angle
of 191"05'45" measured west to south from the previous course,
along the northerly boundary of said Lot 3 and also the northerly
boundary of Lot 19; Block 37, 215.23 feet to the northeast corner
of said Lot 19; thence run south with an included angle of 90°00'
00" along the easterly boundary of Lot 19 thru 23, Block 37 and
Lots i thru 11, inclusive, Block 36, 450.0 feet to the Point of
BEGINNING. Subject to easements and rights-of-way of record.
The subject property is located east of Federal Highway, between
Tropic Boulevard and LaMat Avenue.
The above described parcel contains a 2.702 acre parcel of land,
more or less.
Section 2. That the Boundaries of the City of Delray Beach,
Florida, are hereby redefined to include therein the above-described tract
of land and said land is hereby declared to be within the corporate limits
of the City of Delray Beach, Florida.
Section 3, That Section 30-23 of the Zoning Code shall not apply
to the establishment of a zoning classification in this ordinance.
'Section' 4'. That the tract of land hereinabove described is
hereby declared to be in Zoning District SC (Specialized Commercial) as
defined by existing ordinances of the City of Delray Beach, Florida.
Section' 5: That the land hereinabove descriDed shall immediately
become subj"Ct t6 all 'of the franchises, privileges, immunities, debts,
obligations, liabilities, ordinances and laws to which lands in ~he City
of Delray Beach are. now or may be subjected and persons residing thereon
shall be deemed citizens of the City of Delray Beach.
Section 61 That this annexation of the subject proper=y, in-
cluding adjacent roads, alleys, or the like, if any, shall not be deemed
acceptance by the City of any maintenance responsibility .for such roads,
alleys, or the like, unless otherwise specifically initiated by the City
pursuant to current requirements and conditions.
Section' 7. That if any word, phrase, clause, sentence or par= of
this ordinance'shall be declared illegal by a Court of competent jurisdic-
tion, such record of illegality shall in no way affect the remaining
portion.
