The Council met in regular session at 7:30 P.M.

Application from Henry K. Clem; together with attached
consent si.gnatures of nine ad jacm t property owners; for
permission to ereot a garage and fUling station on the
corner of N.W. 2nd St. and N.W. 5th Ave. wes read. This
property is noft. Residence III Zone. The Clerk was instr-
uoted to edvise Clem he will have to post a $5.00 reques~
for speoial permit fee. and then turn the matter over to
the Zoning Commission for study and recommendations.
Manager~dmond presented requeat for building permit
on lot 4 Block 114. Federal Highway. for an automobile
display room. After discussing the matter. the Manager
was inStructed to advise the person making request that
that type or business is allowed in that particular zone.

Letter signed by Edwin Allabough regard ing water
pressure at Seagate. should Byrd Beach buy surplus water
through Seagate was read. and turned over to the City
Manager for reply.
Communication from the City Manager was read
regarding Gracey's proposed subdivision in Section 8.
recommending that the street which now is dead end. is
extended the full length of the subdivision. and that the
extenswn be paved without concrete header. Or that
Mr. Gracey deposit with the City the cost of the header
at an estimate of 6011 per lineal ft. That one half of a
fifty foot street along the full width cf' the west side
of the property be deducted as a street. After discussing
the matter thoroughly. it was regularly moved. seconded
and unanimously carried that the plat be accepted, pending
the acceptance by Gracey c:f' the City MallD8ger's recommendation.

inasmuch as the Council does not favor the removal of
any sand east of the Ocean Blvd.
Proposal from King Cone regarding the south half or
Block 49 except lots 8 and 9 being available for sale
at a price of $1.000 was presented by the Manager. Clerk
was ordered to cheok the city tax status. and the attorney
agreed to check the ~unty tax status. ror report back
ay next meeting.
Manager Edmond reported that when the small water
storage tank top was put on. the tank interior had been
scraped out Which would oause it to rust more quickly
inasmuch as it had not been painted. He submitted bid
from Whitmore Tank Co. of $250 to paint the interior or
the tank with three coa$s of paint. and recommended that
steps be taken ~edlately to preserve the tank. The
Manager will check further wi: th the Whi tm~re Co. regard-
ing this matter.
Request from Fire Chief Barrows for permission to
attend Convent ion 'in Tampa taking one of his firemen with
him w~s presented. The city to pay $50. towards the cost
of expenses involved in the trip. Oouncll advised the
Chief. he could attend providllng he saw that the city had
an acting fire chief during his absence. in the person of
Daniel Meadows.

It was regularly moved. seconded and unanimously
carried that the City purchase two tires for the Plumbing
Inspector's car.
The Cit7 Manager advised the Council that the
transportation he has now is satisfactory; and he would
like to apply the funds the city had set up tor the
purchase of a new automobile for him. towards the build ing
of extension on city_hall. Ccst or extension to run
between $2.500 and ~.OOO. It was moved. seoonded and
unanimously. carried ~ after discussion. that the Manager
proceed .with the extension on a day labor basis. as per
sketch he had submitted to the Co~cil. cost not to exceed
$3.000.

certain conditions as outlined. After disoussing the
matter. the Clerk was ordered to refund $10 of Bowleg's
$15. fee, and Bldg. Inspeotor ordered to grant him a
special permit for his building ( which is in business
zone) providing he set baok 100' from Atlantic Avenue
and comply with other conditions outlined in Zoning
Commiss ion,"s letter. ,
Letter tram F.F. Neafie regarding beach ooncession
was read. Manager Edmond agreed to reply to the comm-
unication.
A letter trom Dwight L. Rogers assuring his co~
operation regarding government spoil area matter was
read and ordered filed.
Communication from C.Y. Byrd requesting meeting
in the near future with the Counoil to settle the zoning
of 'Reid' property was read. C.W. Garner. Chairman of
Zoning Commission, who was in the audience agreed to
check his files, and call a meeting of his Board. after
which he will make his Board's recommendation to the
Council regarding the 'Reid' ~on1ng. then the Council
will Illeet with Attorney Byrd to oOlllPlete the matter.
Letter from Fire Chief regarding additional fire
hydrants was read. The Manager advised he did not think
it wise to purohase a hydrant for a particular corner,
until the overall pipe work is oomp1eted, then to make
the neoessary installations. Chief Barrows requested
that at least the hydrant be plaoed at Golf Course.
which will take 40' or 2" pipe. Manager Ed!lIond agreed
to cheok into this.
The City Manager advised he will write the F.E.C.
people regarding proposal they were going to submit to
the City some time ago.
Wesley Clement asked if he would be granted per-
mission to erect a dry cleaning and laundry plant on
property on N.E. 2nd Avenue in Block 83. He was advised
tha t is his equipme nt did not take over 20 H.P . ,it wotlld
be alright. otherwise he would have to secure a special
permit. If he meets the City requirements. keeps noise
down to a minimum. and does not create a .iisance with
smoke. such a business oou1d be operated in that area.
J.A. ~hayer asked if the City contemplated disposing
of any of its land. and partioularly wmmted them to

consider donating land for a library site., Mayor DeWitt
advised the city only had two parcels of land which it
wanted to dispose of, and that the building committee
of the Library Association, and the Council will meet in
the near future to discuss possible library site.
Attorney Nowlin advised he had checked into the
deed on city owned property in blook 69 and found that we
have a 'marketable title. The Counoil instructed the
Clerk to advertise for sealed bids on the following;-

J C.W. Garner. ChID. of Zoning Commission reoommended
that the zoning of Atl~tio Ave. from N.W. 6th Ave. West
to the Seaboard be cbSnged from BusiDrss Zone #1 to
Residence 11. with a 35' set-back. It was regularly moved.'

Counoilman Hill agreed to oheok into matter of
sewer extension bill reoeived from R.C. Lawson.
Bills #3817~3222 amounting to $6,567.19 having
been approved by the Finance Committee, were ordered
paid.

and final reading:-

Counoilman White advised someone approaohed him re:
rental of city owned equipment. After discussing the
matter. the Council were all of the opinion that no city
equipment shall be loaned. or rented to anyone.
The Clerk was ordered to issue a temporary 30 day
pe~it to Enooh Powell to operate a bus in the city. over
the route he submitted to the Oity Councl1. Said permit
to be revoked immediately upon city finding operation or:
bus unsatisfactory.
By motion regUlarly made. seconded and unanimously
carried. the office of City Tax Assessor was deolard
vacant as of April 1st.. after that date. the duties of
the office to be turned over to the City Clerk ~o will
be acting tax assessor until other arrangements can be
made.
Manager Edmond requested that the Council meet
with Mr. Gillespie and discuss the water pressure at the
beaoh. this coming Wednesday.
There being no further business to come before the
Council. Council adjoured.
