COUNCIL CHAMBER
April 8, 1946
The Gouncil met in regular session at 7:30 P.M.
The following members were present:- Mr. Butler, Mr. DeWitt,
Mr. Hill and Mr. White. Mr. McNeece was absent. Attorney
Nowlin arrived later, but was excused by the Mayor from the
meeting,' due to illness in his family.
Mayor DeWitt asked if anyone in the audience
wished the minutes of meetings held March 25th and April
3rd read. No one did, so minutes were approved as written.
Mr. Hill reported $25.65 had been collected in
electrical permjts and $237.55 in building permits during
the month of March.

Mr. Butler reported a refund check had been
received from Hardware Mutual Insurance Co. to the amount
of $234.38, representing dividend on policy.
Manager Edmond reported he had investigated
conditions at the yacht basin and recommended steps be
taken to have all boats removed by April 15th. That a
new dock be built next year in some other location, perhaps
at the city park site. A letter was read signed by E.C.
McShane and six other property owners, objecting to
condi tions at the yacht basin. After thoroughly discussing
the matter, Mr. White moved that the Parks Committee,
h~ded by the City Manager as Chairman for this project,
investigate the possibility of building new dockage
facilities in ano.ther location sometime during the next.
year. Mr. Hill seconded the motion which carried unanimously
on roll call.

Mr. Edmond submitted colored map on Delocean
property outlining the zoning. It was regularly moved,
seconded and unanimously carried that the Manager submit
the map to the Zoning Commission; advising them that there
was one block, where the Crawford house is located, which
does not conform with the other zoning in the area.
Recommendation was read from Zoning Commission
dated April 8th that the area to be known as the Special
Hotel and Apartment District include all that property
situated east of Andrews Avenue and all that fronting on
the Ocean Boulevard north of Atlantic Avenue. ahw South
of Thomas Street; also all lots abutting the Ocean Blvd.

south of Atlantic Avenue and north of the south line of the
Williamson-Diebel SiD; and also all Ocean Beach lots south
of the Williamson-Diebel SiD and north of Nassau Park SiD.
Clerk was instructed to have the Attorney draft
an ordinance amending the Zoning Ordinance, to conform with
the ~~ing Commissions recommendation for re-zoning Beach
section according to their letter dated April 8th., by
motion regularly made, seconded and unanimously carried.

Next a recommendation from Zoning Commission
regarding H. P. Lamson request was read, in which they
recommended that the east half of block 78, the east half
of block 79 and all of block 80 lying west of the railroad,
be changed to "Indus trial Zone" and that the regular
procedure be followed out re: block 79 and 80 (public
meeting of property owners). The City Manager was instructed
to write the Zoning Commission asking that usual procedure
be followed regarding blocks 79 and 80 at an early date.
Also that Manager notify Mr. Lamson of this action.
Zoning Commission recommended that H. P. Clem be
granted Special Permit for building a garage and service
station on corner of N.W. 2nd St. and N.i'l. 5th Ave.,(said
property in Residence II 1 2l!l'ne ) 'inasmuch as adjacent property
owners felt it would be a convenience to them. Councilman
'Nhite advised that the City Attorney had stated previously
that no special permits could be issued in Residence zones
for businesses. Matter was tabled for further check with
the Attorney.
Letter from Civic League asking that businEss
zone on 5th Avenue be extended one block north of N. W.
2nd Street, and that the business zone on West Atlantic
Avenue be extended to N. W. 8th Street was re~d. The City
Manager was instructed to advise the first signer of the
letter - L.L. 'Youngblood, Chairman - that it will be
necessary for them to post $15.00 request for change 01'
zone fee, before thamatter can be turned over to the
Zoning Commission for their consideration and recommendation.
Mayor DeWitt advised that the Attorney had
secured the price of $650.00 for printing 01' 500 copies 01'
city code, charter of the city to be included in the booklet.
The matter was turned over to the Finance Committee with
power to act, by motion regularly made, seconded and
unanimously carried.
The Clerk was ordered to write the City Attorney
asking' him to draw up an ordinance l1mi ting the speed 01'

Report from Smith & Gillespie regarding water
system was read and discussed. Manager Edmond reported he
would contact the U. S. Geodetic Survey in Miami next week.
Mr. Hill advised if additional pressure is to be furnished
the beach, and if a storage tank is placed north of town,
it would be wise to install the water pipe under the canal
at the time dredging work is done in that area, then when
the tank is built, the pipe will be ready to tie into.
The clerk was instructed to issue occupational
license to Prince Farrington and D. M. Carr.
Mr. ~ames L. Betts who wishes to operate an air
taxi, using the Intracoastal Waterway for landing and
taking off, addressed the Council regarding the possibility
of securing a city license. After thoroughly discussing
the matter, the Mayor asked Mr. Betts to secure a plant
and land and take off in the canal during the next two weeks.
Notice will be printed in the local newspaper, and the
Council will request property owners in that area to send
in their written opinion as to whether or not' they desire
that type bu~lness. After the owners are heard from, the
Council will give Mr. Betts request further consideration.
The Clerk was instructed to write R. C. Lawson
"regarding the $134.00 b~ll for sewer work, advising him
that in the past it has been the practice of the Council
to assess the abutting properties for such work. City only
pays for the maintenance of sewers.
Bills # 5223 through 3275 were ordered paid
after C. J~ White approves them. Bills totaled $7,667.45.

the Council, Council adjourned.
