Mayor DeWitt stated that we should have a
representative at this meeting, and he would try to attend.
Upon motion of Councilman McNeece, seconded by
Councilman Hill, unanimously carried, a building permit
applied for by Mr. Wesley Clements for building to be
constructed of corrugated metal, wae denied..

A motion was made by Councilman Hill, seconded
by Councilman Butler, unanimsusly oarried, that City
Attorney Nowlin be requested to obtain an estimate of
the cost of preparing an abstract on the Golf Course
property, to which the City is taking title, including
the adjoining twenty acres.
The Clerk presented proof of the publication
of a notice calling for bids on $350,000.00 Water Revenue
Certificates, which notice was pUblished in The Bond Buyer
and the Delray Beach News on June 7th and 14th, bids to be
received up to 8:00 P,M., Eastern Dayligh~ Saving Time
on.June 18th,1946.
The foregoing proofs were ordered spread upon
the minutes as follows:

The City of Delray BeaCh, Florida, will receive
sealed bids up to 8:00 O'clock P. M. Eastern
Daylight Saving Time on the 18 day of June 1946,
for Water Works Revenue Certificates in the amount
of $350,000.00 under the following proposal:
The City will at its own expense, cause the
issuance of such certi~icates to be validated.
Such certificates whall not impose any tax
liability upon any real or personal property in
the City of D elray Beach, Flor ia a, nor 00 ns t iturte
a debt against the City, but shill be a lien only
against the revenues of Buuh utility. The success-
ful bidder shall furnish the certificates for
issuance by the city and shall secure an opinion
from a recognized bond attorney as to all legal
matters in regard to validation proceedings without
cost to the ollt.y.
Certificates shall be issued in the denomination
of $1,000.00 each, shall bear interest from date of

2. All callable.

The bidder shall bid both on the amount to be
paid for the certificates and also on the amount of
interest such certificate ~hall bear and all bids
Shall be accompanied by a cashier's check or certified
che ck for 3 per cent of the amount of t he bid.
The City reserves the right to reject any and

Gentlemen:
In response to your advertisement in the Bond Buyer of
dune 8, 1946, requesting bids on $350,000.00 Delray Beach
~ater Revenue Certificates, maturing as shown in schedule,
we are pleased to make you a bid of 99,12 plus accrued
interest to date of delivery, for certificates bearing
2*% interest, payable semi-annually, at some bank in
New York City, and. subject to the final approving opinion
of Masslich & Mitchell of New York City, or somecother
recognized bond attorneys.

The proposed certifjcates may be issued as an open lien
and additional certificates may be issued providing the
ne t annual revenue of the Wa tel' Utility for twelve con-
secutive months, equals one and one-half times the annual
principal interest requirements of all issues, and the
City to agree to set up and maintain a reasonable reserve
fund for servicing these certificates.
All certificates will be callable after ten years from
date, at 103 and accrued interest and the call premium
to be reduced one-fourth of one percent each year there-
after. We agree to pay all the expenses of printing and
delivering the blank Revenue Certificates and also to pay
the expenses of furnishing the approving opinion of some
recognized bond attorney.
The suggested date of bones to be duly 1, 1946 and the
City is to have the certificates validated and delivered
to us properly executed, wi thin a reasonable time.
As evidence of food faith, we are attaching Cas':1ier's

Bond Committee to be held at 9:30 A. M. on Wednesday,
June 19th, to study the bids and decide which bid would
be the best for the Ci ty.
A letter from Mr. Fred D. Sellers was read,
as follol'iS:

On June 14th, 1946, I made a deposit as a binder
the purchase of Five \5) acres of ground located in
Beach, Florida, and described as follows:

This land is .bounded on the North side by lands
belonging to the City. On which is located the City Water

In checking this piece of ground,. I find that
our City Manager, Mr. Edmond, is very desirous of acquiring
this certain piece of property for the City.
My reason for tIlls letter to you is, if the City
is interested, and has any intention of acquiring this
property, rather than have any dissention or condemnation
proceedings, I offer to sell my equity to the City so they
can go ahead and buy it. If the City is not interested,
then I will proceed as I have planned.
I propose to build a street throuel1 the center
of this property, wi th easements on the sotlth, west and
north. In every way conforming .GO the requirements of
the City. Sub-divide and develop as reserlential section.
I will greatly appreciate your prompt attention
to this matter, as my option e:xpires on June 21st.

City Manager Edmond explained to Council that
the tract of land described in the foregoing letter was
bounded on the west and north by City owned property,
adjacent to the City Water Plant, and that as tte City
grows this land will be needed for expansion of the water
plant. The matter was deferred until a later meeting.
Council then adjourned unt il 2:00 P.M. on
Wednesday, June 19th, at which time the best bid for the
$350,000.00 City of Delray Beach Water Works Revenue
Certificates will be accepted.
