Regular meeting of the City Council of the City of Delray Beach was held
in the Council C~ambers at 7:30 P.M. with Mayor M. M. DeWitt in the Chair, City
Manager H. P. Edmond, City Attorney J. W. Nowlin, and the following Councilmen
present: B. C. Butler, F. B. McNeece, J. B. Smith and C. J. White, a quorum
being present.
The minutes of the meetings of October 14th, 15th, 21st and 22nd were
presented and approved as written.
City Manager Edmond presented a request for building permit for the con-
struction of a restaurant on the South Federal Highway 100' north of Gennantown
Road, the building to be of concrete construction. Mr. Edmond advised the
Council that the plans meet all zoning and building code requirements, and have
been approved by the State Hotel Commission.
A motion was made by Councilman McNeece, seconded by Councilman White, that
building permit be granted, and upon call of roll the motion carried unanimously.

Mr. Edmond reported that he had obtained approval from the State Board of
Health for the drilling of an 8" drainage well at Nassau and Gleason Streets.
Howeverl there is a possibility that this will not work. It will cost approxi-
mately ~600.00 to drill the well. To lay a pipeline to the canal for drainage
of this area would cost between $2,000.00 and $2,500.00, but we know that WDuld
work. The only other solution would be to raise the street level and let the
property owners take care of the drainage.
The fact that the natural drain to the canal has been filled up by the
Delocean Company in filling in their property was brought out, which has created
this situation on Nassau Street, and it was suggested that the matter be with-
held until a conference can be held with the Delocean Company's Engineers, and
the property owners on Nassau Street, to see what can be worked out.
Action was withheld on a request from Mr. E. H. Varno, owner of the Tik-Tok
Restaurant for a permit to drill a drainage well in front of his property,
preferably between the sidewalk and the curb, to carry off the overflow from
a cesspool used in connection with his kitchen. There was a question as to
whether this would be on City or County property, and the City Attorney was
instructed to check this point before Council acted on the request.
City Manager Edmond presented a plat of a Resubdivision of part of Block 66,
owned by Mr. C. H. Landers, but no action was taken by the Council pending
approval of the County Engineers.
The Clerk presented requests from twelve persons whose names appeared on a
petition circulated by Mr. W. A. Jacobs with reference to the validation of
$350,000.00 Water Revenue Certificates, asking that their names be taken off of
the petition. These requests were ordered filed.

proposal of the Delray Transit Company for the operation of a bus service

The Delray Transit Company, a partnership composed of Clarence Cook,
Leroy Croft and Paul Sanderson, desire to operate a bus line in the City
of Delray Beach, Florida, and would like to obtain a temporary permit from
the City Council for such operation.
We plan to start operation of bus service on December 1, 1946. At the
start of this service we plan to use two city type busses made by the Yellow
Coach Company which are equipped with all desirable safety features for city
bus operation. We will carry liability insurance for the protection of
patrons with a limit of $50,000.00 for anyone individual and a limit of
$100,000.00 for any one accident.
We plan to operate our bus service each day except Sunday from 7: a.m.
to 6:30 p.m. The fare will be 10~ and provision will probably be made for
transfers from one part of Town to the other.
We intend to operate one bus in the Northern portion of the City, operating
on an hourly schedule starting at the intersection of Atlantic Avenue and
Swinton Avenue, thence north on Swinton Avenue to N.E. 4th Street, East to
N.E. 5th Avenue, North to LaHacienda Subdivision, South to N. E. 8th Street,
West to Winton Avenue, South to Atlantic Avenue, East to the Ocean Boulevard,
North to Jamaica Square, South to Atlantic Avenue and West to Swinton Avenue.
The bus in the Southern portion of the City will start at Swinton and Atlantic
Avenues, go South on Swinton Avenue to the Germantown Road, East to S.E. 5th
Avenue, North to S.E. 2nd st., West to Swinton Avenue, North to Atlantic
Avenue, East to the Ocean Boulevard, South to Seagate Subdivision, North to
Atlantic Avenue and West to the Intersection of Swinton and Atlantic Avenues.
Each of us will operate on an hourly schedule and the schedule will be so
arranged as to furnish one-half hour service on Atlantic Avenue from Swinton
Avenue to the Ocean Boulevard.
We desire to furnish a modern up-to-date bus service for this community.
We believe that the proposed schedule and route set forth above will furnish
this type of service and we respectfully request that a permit be granted to
us to operate a bus service as requested above. If after this service has
been in operation for sometime, it becomes apparent that certain changes in
the schedule or route would be desirable, we will be glad to cooperate wi th
the City officials in working out such changes. We are attaching hereto a
map showing the proposed route to be serviced by our busses.

Mr. Sanderson explained that they were asking for a temporary permit at
present, until May 1st at least, and they planned to operate on half schedule
during the summer if possible, depending on how much traffic there will be.
He also explained that the busses are being rebuilt now, and they hoped to
start operation by December 1st. The insurance requirements will be checked
and the Delray Transit Company will comply with all requirements.
Council assured Mr. Sanderson that a temporary permit would be granted.

The Clerk presented proof of publication of a notice calling for bids for
the rebuilding of the Tennis Courts, which proof was ordered spread upon the
minutes as follows:
"INVITATION FOR BIDS
The City Council of the City of Delray Beach, Florida, will receive until
7 :30 p.m., October 2Sth, and then open publicly, sealed bids for the rebuilding
of the six municipal tennis courts according to specifications on file in the
City Clerk's Office. The City Council reserves the right to accept or reject
any or all bids for any reason at its discretion.

One bid was received in response to the foregoing notice, from F.C. Feise
Co. of West Palm Beach, in the amount of $2,985.00. ,
A motion was made by Councilman White, seconded by Councilman Butler, that
the foregoing bid be accepted, and upon call of roll the motion carried unani-
mously.
Councilman Butler, as Chairman of the Finance Committee, presented an
offer from Mr. 'tlilliam Clancy of the Lumbermen's Credit Association, Inc., to
sell to the City $9,000.00 City of Delray Beach Refunding Bonds at 99 and accrued
interest.
Council was advised by the City Attorney that we would have to advertise
for offers from bond holders before we could accept this offer, and that Mr.
Clancy should be instructed to resubmit his offer in response to our advertise-
ment, whereupon a motion was made by Councilman White, seconded by Councilman
McNeece, that an advertisement be placed in The Bond Buyer and in the Delray
Beach News, for offers to sell City of Delray Beach bonds, said offers to be
accepted until 8:00 P.M., November 13th, 1946. Upon call of roll the motion
carried unanimously.
Any action contemplated on calling bonds by lots was postponed until the
City has advertised again for offers.
The Clerk presented a bill from E.E. Hageman for work done and material
furnished for painting the City Pavilion, in the amount of $509.80. This work
was authorized by the City Council on September 11th, 1944, and Mr. Hagerman
claimed that he had not been able to obtain the paint for some time and he had
done the work during the next year.
No action was taken on this matter pending further investigation as to when
the work was completed and when it was approved.
Mr. A. L. Greenwood, Tax Collector, presented an application for a beer
and wine license, together with a restaurant license, in the name of John S.
Haber, to be located at 121 S.W. 5th Avenue.
The application being in order, license was approved in a motion made by
Councilman Smith, seconded by Councilman McNeece, and unanimously carried.

October 28th, 1946
Bills totaling $3,843.98, having been approved by the Finance Committee,
were ordered paid, in a motion by Councilman Butler, seconded by Councilman
McNeece and unanimously carried.
The following ordinance was then brought up for 1st reading, and same
was read in full:
AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF HELRAY BEACH, FLORIDA,
PROHIBITING THE TYING OF BOATS TO ANY
TREES, POSTS OR OTHER OBJECTS ALONG
CANAL STREET SOUTH OF ATLANTIC AVENUE
EXCEPT IN THE CITY YACHT BASIN, AND PRO-
VIDING A PENALTY FOR VIOLATION THEREOF.
Upon motion of Councilman McNeece, seconded by Councilman Butler,
unanimously carried, the foregoing ordinance was passed on first reading.
Council then recessed until 7:30 P.M., Tuesday, October 29th, 1946.
