01-82 Unimproved - Construction Started 5.21 Acres -- West side of Delray between Atlantic Avenue and Lake Worth Drainage District Equaliz. Canal E-4. ORDINANCE NO. 1-82 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, ANNEXING TO THE CITY OF DELRAY BEACH A PARCEL OF LAND LOCATED IN SECTION 18, TOWNSHIP 46 SOUTH, RANGE 43 EAST, WHICH LAND IS CONTIGUOUS TO EXISTING MUNICIPAL LIMITS OF SAID CITY; REDEFINING THE BOUNDARIES OF SAID CITY TO INCLUDE SAID LAND; PROVIDING FOR THE RIGHTS AND OBLIGATIONS OF SAID LAND;' AND PROVIDING FOR THE ZONING THEREOF. WHEREAS, Norman G. Jackson, a single man, is the fee- simple owner of the property hereinafter described; and, WHEREAS, Norman G. Jackson, has requested by his petition to have the subject property annexed into the municipal limits of the City of Delray Beach; and, WHEREAS, the designation of a zoning classification is part of the annexation proceeding, the City Council has determined that the procedures set forth in Section 30-23 of the Zoning Code, which applies to property already in the City limits, shall not be applicable in annexation proceedings; and, WHEREAS, the City of Delray Beach has heretofore been authorized to annex lands in accordance with Section 171.044 of the Florida Statutes, . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the City Council of the City of Delray Beach, Palm Beach County, Florida, hereby annexes to said City the following described land located in Palm Beach County, Florida, which lies contiguous to said City to-wit: A parcel of land in the Northeast Quarter (NE%) of Sec- tion 18, Township 46 South, Range 43 East, Palm Beach County, Florida, being more particularly described as follows; to-wit: Commence at the Northeast corner of said Section 18; thence Westerly along the North line of said Section 18, a dis- tance of 370.11 feet to the Point of Beginning of the parcel to be herein described; thence continue Westerly along the same course a distance of 313.47 feet to a point being 300 feet westerly of as measured at right angles to the westerly right of way line of Seaboard Airline Railway; thence run Southerly parallel with the said Westerly right of way line of Seaboard Airline Railway, a distance of 42.13 feet to the point of tangency of a curve 300 feet Westerly of ~nd parallel with the said Westerly right of way line of Seaboard Airline Railway; thence run Southerly along the arc of said curve a distance of 715.53 feet to a point in the North line of that certain real property described in Official Record Book 245 on pages 441 and 442, as recorded in the Public Record of Palm Beach County, Florida; thence run Easterly along aforesaid line a distance of 301.19 feet to a point in the afore- mentioned Westerly right of way line of Seaboard Airline Railway; thence run Northerly along the arc of said Westerly right of way line a distance of 623.31 feet to the point of tangency of said curve; thence run Northerly along said Westerly right of way line, a distance of 132.81 feet to the Point of Beginning. Subject to any rights of way or easements of record. Subject to Florida Power and Light easements recorded in Deed Book 608, page 167. The above-described parcel contains 5.21 acres. Section 2. That the Boundaries of the City of Delray Beach, Florida are hereby redefined to include therein the above- described tract of land and said land is hereby declared to be within the corporate limits of the City of Delray Beach, Florida. Section 3. That Section 30-23 of the Zoning Code shall not apply to the establishment of a zoning classification in this ordinance. Section 4. That the tract of land hereinabove described is hereby declared to be in Zoning District M-I (Medium Indus- trial) District as defined by existing ordinances of the City of Delray Beach, Florida. Section 5. That the land hereinabove described shall immediately become subject to all of the franchises, privileges, immunities, debts, obligations, liabilities, ordinances and laws to which lands in the City of Delray Beach are now or may be subjected and persons residing thereon shall be deemed citizens of the City of Delray Beach. Section 6. That if any word, phrase, clause, sentence or part of this ordinance shall be declared illegal by a Court of competent jurisdiction, such record of illegality shall in no way affect the remaining portion.
