02-82 ORDINANCE NO. 2-82 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, PROVIDING FOR CHARTER CHANGES TO ARTICLE V."ELECTIONS", SECTION 5.05. "CERTIFICATION OF ELECTIONS" SUBSECTION (a) TO ELIMINATE THE CERTIFICATION REQUIREMENT BY THE CLERK OF ELECTIONS AND THE MAJORITY OF THE IN- SPECTORS OF THE ELECTIONS; PROVIDING FOR A REFERENDUM ELECTION TO BE HELD MARCH 2, 1982; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFECTIVE DATE. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, AS FOLLOWS: Section 1. That the Charter of the City of Delray Beach, Flor, ida, Chapter 25786, Laws of Florida, Special Acts of 1949, and amendments thereto be further amended as follows: ARTICLE V. ELECTIONS Section 5.05. ~e~e&~e~ Returns of elections. (a) The results of the voting, when ascertained by the Super- visor of Elections, shall be e~b~be~-~y returned in duplicate? e&gme~ ~-~he-~qe~k-~f-~l~c~i~~-~e-me~e~-e~-~he-~s~ee~e~s-~-~he-e~ee- e&e~sL one copy to be delivered to the mayor and the other to the city clerk, both of whom shall transmit such returns to the city council at a called meeting to be held not later than three (3) days after such elec- tion. At such meeting the city council shall canvass the returns, and in the absence of a declaration of a contest by any of the candidates in such election, shall declare the results of the election as shown by the re- turns made by e~4e-~h~a~-~pee~e~-~--~i,~-e~ee~e~ the supervisor of elections. Section 2. That this ordinance shall not be effective unless the same is approved by a majority of the electors of the City of Delray Beach voting at the election to be held March 2, 1982, for the purpose of ap- proving or disapproving this ordinance. The question to be submitted to the electors at such election shall be substantially as follows: AMENDMENT TO THE CITY CHARTER OF THE CITY OF DELRAY BEACH TO ELIMINATE THE CERTIFICATION REQUIREMENT OF THE CLERK OF ELECTIONS AND THE MAJORITY OF THE INSPECTORS OF THE ELECTIONS. SHALL THE ABOVE DESCRIBED CHARTER AMENDMENT REFERENDUM ORDINANCE BE ADOPTED: FOR APPROVAL ~ AGAINST APPROVAL ~ If a majority of the electors voting upon such question approve the amendment, then the amendments shall be in full force and effect. If a majority of the electors voting upon such question disapprove such amendment then this amendment shall be null and void. Section 3. That upon the approval of this Ordinance by the electors as aforesaid, all ordinances or parts of ordinances or Charter provisions or parts of Charter provisions in conflict herewith shall be and the same are hereby repealed as of the effective date of this Ordi- nance. Section 4. That if any clause, section or other part of this Ordinance shall be held invalid or unconstitutional by any court of com- petent jurisdiction, the remainder of this Ordinance shall not be affected thereby, but shall remain in full force and effect.
