COUNCIL CHAMBER
January 22nd, 1945
The Council met in regular session at 8 P.M. with all
members of the City Council and the C1 ty Attorney present.
Minutes of regular meeting held January 8th., and
special meetine held January 15th., were read by the Clerk
and approved as read.
The Mayor advised he had written the F.E.C. officials
regarding Atlantic A.venue cros.sing. He also advised a Mr.
Ryan had offered City of Delray Bonds firm at 95.70 until
January 23rd. At this tirre, City AIlditor Winn addressed the
Council and quoted e~j:'pts from the minutes which showed
the last bonds the city bought after advertising, were bought
at 94.5 Attorney Nowlin stated if this was the case, the
city could not pay more than 94.5 for bonds until we ad-
vertised' again. Mayor Thayer agreed ,to notify Mr. Ryan of
this decision.

A letter from Mrs. Marshburn'tequesting rocking of
alley entrance was by motion regularly made, seconded and
carried, turned over to the Street Committee for investiga-
tion and report.
Next a communication from Mrs, Henry J. Sterling was
read requesting the City do something to cause the public
to wrap in paper, wet garbage before placing in the garbage
containers. Councilman Jacobs stated he was in favor of
passing a resolution which would instruct the collectors to
pick up only garbage that was properly prepared for the cans.
Mayor Thayer suggested he start an educational campaign
through the 'News' regarding this matter. The Council auth-
orized him to proceed wi th this campaign. The Clerk was
'instructed to notify !lrs, Sterling of the Council's action.
A communication from the Town of Gulf Stream, reject-
ing the City's offer of furnishing fire protection fltr one
year for a flat fee of $500. was read, in which they offered
to pay the City $100. for each call answered there. This
letter was table,d for further consideration.
Communication from Bishop John \Vingl'~questing exemption
for St. Matthew's (colored) Parish House was read, and
ordered turned over to the ~,AA"ES, sessor for investigation,
and report. , '

Next, reSignations frcm M. M. DeWitt and J.C. Keen as
members of the Golf Committee were presented. Council-
man Waters moved that!lr. DeWitt's resignation be accept-
ed with regret, and thanks for his service on this committee.
Mr. Jacobs seconded the motion and on roll call the vote was
as follows: Mr. DeWitt, not voting, Mr. Jacobs Yes, Mr. Thayer
yes, Mr. ,Waters yes, and Mr. White yes. Motion carried.

Next Mr. Waters moved that Mr. Keen.'sresignation be
accepted with regret and thanks for his service. Mr Jacobs
seconded the motion which carried unanimously on roll cal1~

Mrs. C. A. Womack who was in the audience presented a
'rough sketch for a 16 x 24' concrete block dwelling which she
asked ,the Council to grant her permission to build on her lots
in Osceola Park, on S.,E. 3rd Avenue and 5th St. By motion
regularly made, seconded and unanimously carried, Mrs, Womack
was granted temporary penni'tji to build this dwelling, provid-
ing that wheh materials become available she' will add on to
it, to make it comply with "B" zone requirements in that dis-
trict.

The following members of the Jllanning Board next came
before the Council. Chairman H. A. Hubbard, members Samuel'
Ogren and F. H. Link. !Ir. Hubbard reporped his ~ommittee
had worked with a colored committee and drafted a zoning or-
dinance f,or colored term, which ha explained to the, Council.
He reccmmended the City purchase property in section 8 out-
side the. city limits near Lake Ida for a site for sewage
disposal plant which may be built in the future. other changes
in the zoning ordinance were discussed, after ltlich Mr. Hubbard
presented the Board's recommendations in report fonn. By
motion regularly made, seconded, and carried the report was
accepted by the Council with an expression of thanks to the
Board for their fine work. The Clerk was instructed to draft
copies of the report for each member of the Council.

Mr. Hubbard asked the Council to arrange to have the Bantl
Shell in order so that the band can have its first public concert
Sunday afternoon at 3:30 P.M.. February 11th. He stated chairs
would be needed for the public in front of the Band Shell also.
Plumbing Inspector Pinckney advised the Council quite a
number of old sheds and garages are being converled into dwell-
ing places, and he thought some investigationewere in order. No
action was taken on this.
Councilman JacObs recommended that the City advertise for
bids for the digging of ditch at disposal dump, according to
the following specifications: 430' long, 25' wide at top, 8'
wide at the bottom and 10' deep. By motion regularly made,
seconded and carried, the Clerk was instructed to advertise for
bids.. WorJt to be done between May 1st,. and May l;Qth.
A discussion followed regarding parking of trailers with-
in the city, and the Council agreed"t'o investigate this matter
further.
By mdtion regularly made, seconded and carried, Bill #2113
amounting'to $309.45 (J.G. Fitzgerald) for a new sewer scooter
Which will be ,used to clean the some ten miles of sewer line in
the City,> both 8" and 15", was ordered paid.
The);'Clerk was instructed to send copies of Resolutions
#511 and 512 to all owners of P1'9perty in Hofman Village and
Seagate who had rot signed a, copy yet, in order that we may
have YfI'ltt.en consent of their iropertiesbeing incorporated into

Councilman JacObs advised the Council he had talked with
Citizens who intimated the County might be willing to build a
new road to our cemetery from Germantown Road north. The Chair-
man of the streets Committee agreed to investigate this possi-
bilityand report back to the Council his findings.
A communication from the Clerk regarding salaries was
tabled, and the Finance Committee agreed to confer Wednesday
evening at 7:30 P.M., and make their recommendation to the
Council at the Special meeting to be held. that night.
Upon recanmelidation of the Mayor, Gus Anderson and wcy
Love were appointed members of the Plumbing Examiners Board.
Councilman DeWitt stated report from state Board of Health
re: water test, showed our~ water to be satisfacp>ry.

Councilman Waters said he thought the taxi stand on the
corner of Atlantic Ave and S.E. 5th Avenue was using too much
of the street for parking of their cabs. Councilman White ex-
pressed himself as being in favor of them having as much park-
ing space as is allowed the Hotel across the street. No action
was taken.

The Ilayor read a report relative to the operating cost
of the golf course during the last year it was opened, showing
expenses and receipts. He stated Joe Wilson could have the
course ready fo I' public play in from two<' to three weeks, if
the City wished to reopen it. He also advised the Kiwanis
and Lion's Club were discussing the matter at their meetings,
and that a large nUlllber of private citizens had expressed them-
selves as being very much in favor of having the course re-
opened.
The Council recommended the report be turned over to the
Golf Committee for their recommendati on.
The Mayor stated the Clerk has started a drive to collect
unpaid occupational licenses. Also that he, the Mayor, is work-
ing on the Chamber of Commerce matter. '

, ' A request from Hugo Krettzberg to build two porte-cocheres
on.ti;p his apartments which would only allow 2' from the property
line on one side of ,the property and 4' on the other side, Was
, rejected.

to issue occupational license to Arden Kullberg for an elec-
trical repair shop at the Zeder Camp.

Attorney Nowlin advised the Clerk must with-hold tax
from Council's salaries, but that he and Auditor Winn were
working on a fee basis and their fees were not subject to
with-holding tax.
Bills #2100-2ll2 and 2ll4-2121 amountirlg to $4,211.34
having been approved by the Fi.nance Committee, were by motion
regularly,made, seconded, and carried, ordered paid.
Attorney Nowlin turned over to the ,Clerk deed fran W. B.
Stewart for property in Sec. 8, which he'aaid was in proper
fonn.

Refunding contract for Gracey ljI!ls presented by Attorney
Nowlin, but due to an error in lot numbers no action was taken
at this time, and the Clerk was instructed to make necessary
corrections for the Attorney.

By motion regularly made, seconded and unanimously carried,
Mr. Wilson Harvel was employed by the City and is to receive a
sa~ry of $165.00 per month.
