07-09-45 Regular COUNCIL CHAMBER . July 9, 1945 The Council met in regular session at 8 P.M. with City Attorney Nowlin, and the following members present: Mr. DeWitt, Mr. Jacobs, Mr. Thayer and Mr. Waters. Mr. White was absent. , Minutes of regular meeting June 25th were approved. A sample map of the city from J. M. Smedley was examined by the Council. The Clerk was instructed to notify Mr. Smedley that the OOUncil would like to be assured the block numbers Would be shown on the map before any order is placed. Communication from County Commissioner Byrd, to- gether with resolution relattve to right of way for new highway was presented. Attorn'ey Nowlin was inStructed to prepare a Resolution for the City, to be acted upon July 11th. ~ Next, a letter from Dr. James Nieder requesting reduction on 1942 taxes,was read. This was turned over to the tax assessor for investigation and report. Recommendation from Zoning Commission was presented as follows: Re: Special Permit for Walter Roth to erect a paint shop and garage on vacant lot in block 74 which is in "B" zone. Board recommended application be denied. COUncil will give their deciSion on this " July'llth. Re: Re-zoning of one block on South Federal Highway. This matter too important to be passed on without carefully considering the whole street . Recom- mendation on this matter ~ll be made later. , Communication from Secretary of the Planning Board regarding housing project for this city was presented. By motion regularly made, seconded and carried, the Secretary was advised to follow thromgh with whatever information is necessary to a.id in this projeot. A lengthy letter from Senator Andrews pertaining to Intracoastal Waterway was ordered turned over to each member of the Council for their study. '. ~. , ~ July 9, 1945 At this time Mr. C. Y. Byrd addressed the Council requesting that they meet with Mr. Garris to discuss zoning of the old Zook tract which now is not zoned. The Mayor invited Mr. Garris to meet with the Council, either Tuesday or Wednesday morning between 10 A.M. and 12 A.M. . Wm. KBause asked what steps were necessary to obtain a change in zone on some ocean front property which he owns. He,' was advised to prepare a petition for the Council. Mr. Jacobs stated he had investigated the pony which had been complained Of, and found the yard where same is kept to be in a good condition. He said he thought the general public should be impressed with the importance of keeping premises clean to avoid fly b~eeding places. He also reported the need for having barnacles removed from life line posts in the ocean. The Mayor advised this work will be started soon. By motion regularly made, seconded and unenimously carried, plat of A.J. Johnson SiD was approved by the Counciib. Letter from State Board of Health approving of the City's waterworks improvement plans was read and ordered filed. ~Ne~t a report from Charles Senior relative to his having put the Go1,f Course on a new rate schedule for power, which will mean a considerable saving to the city was read. The Clerk was ordered to thank Mr. Senior for his report. The Clerk was instructed to issue occupational licenses to the followingfirms:- Sutton Electric Co. , R. Logsdon - Plumbing S. C. Chatman - grocery Modern Shoe Shop - repairs. Southern Utilities application for license was rejected. Application for liquor license by Oscar Mansfield, colored, and Jo~ Morey, white were presented. Also check from Jay R. Shattuck,to the amount of '750. ;''If ,. The Clerk was ordered to find out the exact location the applicants intend using for liquor stores; also to tell Mr. Shattuck his check can either be returned to him until October 1st., or can be held in the clerk's office until such time as license can be issued. ., The following Ordinance was placed on its second read ing: ORDINANCE fJ5~5 , . AN ORDINANOE OF THE OITY COUNCIL OF THE CITY OF DELRAY BEACH, FLORIDA, LEVYING, ESTABLISHING AND Th1POSING A GRADUATED TAX ON PURCHASES OF ELECTRIOITY, BOTTLED GAS AND LOCAL TELEPHONE SERVICE: PROVIDING FOR PENALTIE$ 'FOR THE VIOLATION OF THIS ORDINANCE AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES lNSOFAR AS THE SAME ARE CONFLICTING HEBEWITH. Mr. Waters moved that the Ordinance be adopted on its Second and final reading. Mr. DeWitt seconded the motion and on roll call the vote was as foiblows: Mr. DeWitt yes, Mr. Jacobs yes, (with a little mis- givlng), Mr. Thayer yes, Mr. Waters yes. Motion carr ied. County Oommissioner Byrd presented map showing various parcels of land which the County has acquired. The Council viewed same and agreed to study it further the next day, looking for sites suitable for public uses. At this time the Mayor appointed M.M. DeWitt to ~ct as a member of the Finance Committee until the return of C. J.
