The Council met in regular session at 8 P.M.
with the Oity Attorney, and the following members present:
M.M. DeWitt, ;r,A. Thayer, and W.M. Waters. Mr. J"acobs
snd Mr. White were absent.
Mayor Thayer asked if anyone in the audience
wished the minutes of meeting held auly 23rd read. No
one did, so the minutes were approved as written.
Samuel Ogren, dr. presented' a sketch for new
hotel which whe Council viewed, after which a letter
from Samuel Ogren, Sr. was read in which he requested
Special Permission to build same. Property on which
it is contemplated to build the hotel is now in Residence
"An zone. The Council explained that in order to grant
permission for building of hotel, it will be necessary
for Mr. Frederick Duggan, owner, to make formal request
for change of zoning from Residence "A" to Hotel Zone,
accompanying same with $15. required fee; The Mayor
stated Mr. Wm. Krause, o\vner of lot 26 (Ocean Beach
Lots) wished to have his property changed from Residence
nAn zone to "Apartment House" zone. Mr. Waters moved that
these two cases be declared an emergency and that the
Clerk advise Mr. Duggan and Mr. Krause to post their
fee, after Which she notify t~e Zoning Commission of the
Council's action, aSking for their recommendation in the
matters. Mr. DeWitt seconded the motion, which carried
unanimously on ro~l call.
C. W. Garner, Chairman of Zoning Commission
came before the Council with his Board's recommendation
as to Delocean Co. request for change in zoning. The
Commission recommended Delocean's request for certain
blocks to be zoned in Apartment House District, and
Residence "An district, in accordance with Delocean's
letter, be granted. , The request for certain blocks to
be zoned in General Business zone was unanimously
rejected. Mr. Garner explained that the present
business :zones were inadequate to meet the 'requirements
of a high class development. He said General Business
zone would permit many types of businesses which in the
Zoning Commissions' opinion wou~d be undesirable in that
locality. He strongly urged the Council to draw up a

more specific limited business zone ~ich coUld apply to
meet the requirements of the developers. Mr. Waters
moved that the City Attorney check with Mr. Reid's
attorney, finding out exactly what Mr. Reid plans on
putting in his 'Business' property, and that he draft
a Special Zoning Ordinance for that property as regards
business zone. Mr. DeWitt seconded the motion and on
roll call the vote was unanimous.
The Council instructed the attorney to- draw
up the, necessary instruments to convey right-of-way
from Mrs. Burwell Smihh to the city for a ten foot
easement outside the city limits, between 7th and 8th
streets, south, in Seagate.
Letter from ;rUdge Wilcox was read, in which
he advised he had suspended the sentence of Mr. ~.
Ma3i'tin-due to 'illness, and requesting the Counoil's
,approval of his action. By motion regularly made,
seconded and carried, the ;rudge's action in this matter
was approved.
A communication from ;r.L. Martin declining
his appointment by the Council.as Building Inspector,
due to ill health,was read, accepted and ordered filed.
Mayor Thayer advised ;rudge Wilcox is now on
vacation, and recommended that d.M. Cromer serve, if
and when needed during ;rudge Wilcox's absence. It was
'ulymoved, seconded and carried that this be allowed.
Two letters from the Permutit Company, giving
analysis of water, also costs of plants for the City
were read and ordered filed.
Copy of application by Delocean Company for
permission to dredge the Intracoastal Waterway was read-
and ordered filed.
Sketches for pipe line extension across the
canal, together with copy of letter to be drafted to the
U.S. Engineers Office were turned over to the City
Attorney. By motion regularly made, seconded, and
unanimously carried, the following Resolution was adopted.

A RESOLUTION OF' THE CITY COUNCIL OF
THE CITY OF DEL RAY BEACH, FIDRIDA,
AUTHORIZING THE MAYOR AND CITY CLERK
TO MAKE APPLICATION TO THE DISTRICT
ENGINEERS OFFICE. J"ACKSONVILLE. FLORIDA,
FOR ;PERMISSION TO INSTALL A TWELVE INCH
WATER LINE ACROSS THE FLORIDA INTRA-
COASTAL WATERWAY.

The Clerk was instructed to issue occupational
lioenses to the follOwing:

R. A. Smock, Building Contractor.
Benjamin Hodge, Barber - (providing he meets
with the state's requirements.)
Sanitary Inspector George Pinckney advised the
Council he had received complaints regarding a person
south of town occupying a house without the proper
bathroom facilities. He advised, this man has made
arrangements to proceed with putting in the proper
faoilities at an early date. He also recommended that
the Oity Clerk secure a copy of Plumbing Code from the
City of Detroit, Michigan, a!so from Ashville, N.C.
Mr. DeWitt reported 1166 water meters on, 45
off, and 50 at the Water Plant, as of August ,1st.
The Clerk was instructed to change Mr. E.B.
Nichols' used car license from N.E. 4th Ave. to his
property located on South Federal Highway, with the
notation that he must comply with city regulations as
to the dilstance away from the Church his bus iness must

Mr. DeWitt called the attention of the Council
to a bad condition which exists on South Federal Highway
in front of V. Giardano's home. When we have a heavy
rain, the water rises up over the sidewalk making it
impassable. The Clerk was instructed to write the State
Road Dept. requesting relief for this condition. Supt.
Turner agreed to assist the Clerk in composing the
letter.

instructed to advertise for the purchase o~ $30,000.
worth of City of Delray Beach Refunding Bonds in the
Bond Buyer. Mr. DeWitt seconded the motion which carried
unanimously on roll call.
Mayor Thayer stressed the need of a Life Gusrd
at the Beach, and recommended that the City try to secure
a single man so that we can furnish him sleeping quarters
in the City Hall Building.
Mr. Waters moved that the Oity Attorney draft
an ordinance changing the present license fee of $15.
per year for the rental and sale of beach equipment, on
the west side off tba Boulevard, to $1,500. per year, and
that Mr. George Guy bv so notified and given first
opportunity to purchase license at this rate, allowing
him until August 27 to decide. Mr. DeWitt seconded the
motion which carried unanimously.
