The Uouncil met in adjourned session
with all members of the city Council present.
Nowlin was absent.

The Mayor asked for a discussion on the' 'McFee'
matt,er before beginning work on the 1945-1946 buc;l.get.
The Clerk advised she had received a telephone call
from the City Attorney giving 'his opinion in the matter
which was, "from a legal standpoint the law says, that
the fact that the City issued a permit contrary to our
orc;l.inances, does not give Mr. McFee any right to violate
the ordinance. It would not give him any right t,o put
up a building without set-back. The City can stop him
under the permit. The permit does not obligate the
city." From a practicle standpoint Attorney J.'Iiowlin
stated, "something should be worked out allowing Mr.
McFee to go ahead and ask for a special permit to allow
him to build out to Atlantic Avenue. This request to go
to zoning commission and back to the Council. Mr. McFee
deserves some consideration." After a lengthy discus-
sion, the Clerk was instructed to write Mr. MCl"ee; by
motion duly made, seconded, and on roll call voted as
follows: Mr. DeWitt yes, Mr. Thayer yes, Mr. Jacobs
yes, Mr~.Waters not voting, and Mr. White yes; that
the new bakery building on Atlantic Avenue does not
conform to the building ordinance of this city regarding
business buildings on Atlantic Avenue, and that "the
set-back requirements must be complied with. ~o further
building is to go ahead until the set-back requirements
of the ordinance are complied with.~
Mr. Waters was authorized by the Council to
contact Mr. J. A. Martin relative to his re-considering
the position as building inspector.

Next, resignation from Uhas. C. Turner as Supt.
of ~ublic works, effective on or before Se~tember 15th
was read. ~y motion regularly made, seconded, and
unanimously carried, his resignation was accepted, as
of September 15th. The Clerk was instructed to pay
Mr. Turner his annual two weeks vacation pay to which
he is entitled.

It was regularly moved, seconded, and carried,
that wilson narvel be appointed as ~emporary Supt. of
Public works, commencing Sept. 15th. at his present
salary rate.
Members worked on the budget for the coming
year until 5 P.M. at which time they adjourned to meet
in adjourned session on September 17th at 8 P.M. to
complete the Budget work.
