COUNCIL CHAMBER

The Council met in regular session at 8 P.M. with
the following members_present: Mr. Jacobs, Mr. Thayer,
Mr. Waters, and Attorney Nowlin. Mr. white was absent.
Minutes of regular meeting, Sept. 10th. Adjourned
meeting, Sept. 11, Special meeting, Sept. 12th. and adjourned
meeting of September 17th were approved.
The hour of eight o'clock having arrived, sealed
bids were opened, in answer to 'ad' in-the ~ond Buyer. They
were as follows:
Herbert J. Sims. $665. Bond #726 Series 'A' at 98($65l.70
plus accrued interest) A.V. Foster & Co., Inc. $5.000 Re~
funding bonds at 99 and accrued interest.
By motion regularly made, seconded and unanimously carried,
the Clerk was instructed to purchase the above bonds at
prices quoted.
Howard Cromer presented profile and specifications
for proposed sewer on S.W. 4th. St. to service seven new
houses which Mr. Lawson is building. It was regularly
moved, seconded and carried that these plans and specifications
be'approved.

Attorney, representing Mr.. P. Varno and the owner
of the Tik Tok building appeared before the Council objecting
to the issuance of liquor license to J. Shattuck. He was
advised that under the existing. laws, the Council has no
reason for notissueing Mr. Shattuck a license.
The Mayor advised he had written the Seaboard
Railway officials aSking for lights on the platform. Also
the F.E.C. Railway asking for information regarding their
plans on station improvements and for crossing gates; and
congratulating them on having the :right of way fixed. He
wrote Mr. Talbot relative to Air Park. Mr. Thayer said he
had heand the County had foreclosed on the property Mr.
Talbot was negotiating to buy, and that the County had dis-
cussed putting in an Air Park there. Major Art. Sprott
has offered to assist the council in anY way on the Air
Park matter.

Councilman M. M. DeWitt reported plans are progressin~
on the anticipated, work, on water plant.

Councilman Jacobs reported he had received complaint
from Mrs. MacLaren of poison ivy on property adjacent to her
home. After discussion, the Clerk was instructed to inform
the owner of the condition, asking her to have the lot
cleared off. Mr. Jacobs also reported the low place in alley
by Huber's has been fixed.
Councilman Jacobs reported that ~.J.Snow wished to
build a block making plant just west of the City Disposal
Plant, and asked that the dump ground be moved or changed so
the smoke from fires would not interfere with his employees.
Mr. Jacobs told Mr. Snow, No, to this proposition and asked
the Council to approve or disapprove of his action. All
members present approved of Mr. Jacob's action.
Mr. Jacobs recommended that some plan be worked
out which would prohibit planes flying at low altitude over'
the city. ,

Mr. Waters advised he had received a letter from
J. B. Evans requesting the Council get busy on construction
of the new shuffleboard courts. Mr. Jacobs agreed to see
is he could secure someone to build courts, and the Clerk
was instructed to advise Mr. Evans' of this act,ion, also
that the Council had received no bids on the work after
advertis ing same.
By motion regularly made, seconded and carried,
. W. V. Croft was appointed Ac.ting Electrical Inspector. .
The Clerk wa,s instructed to advertise for a combination
Building and Electrical Inspector.

Councilman Waters moved that November 1,'1945 be
set S:s the final date for settling city taoces at a discount,
and that the City Attorney prepare ad for'paper stating ,
this. Mr. DeWitt seconded the motion which carr ied
unanimously on roll call. '
Letter from ~~s. MacLaren was read. The Clerk
was instructed to advise her the city. is writing the,owner
of the property asking for cooperation in the matter. "
A communication from C. y. Byrd asking for com-,
mittment i'rom Council on the iS~lJance of a building permit;
for laundry and dry Cleaning plant. either on lot 10, block
93, or lot 14, block 100 was read. The Mayer agreed to
contact Mr. Byrd requesting more detailed information.

A communication from Capt. M. R. Seta objecting to
the utilities tax was read. The Clerk was instructed to
advise Capt. Seta that at the last session of the State
Leaislature it authorized municipalities to create such
ta~es. It is not a local discrimination, for practically
every community either has it now or is planning to have it
very soon.

Attorney Nowlin agreed to write Mr. Walker of
Smith & Gillespie, aSking him about line where easement must
be secured for proposed pipeline under the Intra-costal
#aterway, on the west side of the canal.
The Clerk was instructed to issue occupational
licenses to James Nolan and Clarence Hearst, providing they
meet with all local requirements as to zone etc. '", "
Application for transfer of liquor license at ~ob'~
~ar to O. L. Kelly and Chas. Cobb from Jno. Morey and
rlarris ~eveson was presented. The Clerk was ordered to
advertise in two issues of the Delray ~each News, in aC-
cordance with city charter.
No objections having been received, as to the
character and capability of John Morey and Jay Shattuck,
the Clerk was ordered to issue liquor license to these
two gentlemen by>~otion regularly made, seconded and
unamimously carried.

$3,899.95 having been approved by the ,l"inance Committee
were by motion made, seconded and carried, ordered paid.
At this time Mr. ,Vaters asked the Council to
consider the application of E. B. Nichols for a building
permit to erect a concrete block structure on his lot
just south of the jjaptist Church. After thoroughly dis-
cussing the matter, Mr. Jacobs moved that permit be granted
with the understanding that there will be no disturbance
on the premises while church is in session. Mr. De Witt
seconded the motion and on roll call the vote was as fol-
lows: Mr. DeWitt yes, Mr. Jacobs yes, Mr. Thayer yes.
Mr. Waters not voting. Motion carried.
W. V. Croft presented application from James
Priest for permission to build a garage apartment in a
residence "B" district. he stated it does not comply
with the Building Code. City Attorney Nowlin recomm~~ded
that the city stick to the Code.

Supt. Harvel advised the City Barn doors'were
off and suggested someone be hired to make necessary
repairs. Mr. Harvel stated he had received shipment of
new Badger water meters and he didn't like the' thought of
using this type meter. Councilman DeWitt stated that
inasmuch as the ~adger Company helped the City out in an.
emergency, he would not,recommend returning said meters.
Representative from Pittsburgh meter Company:',
advised the Council he could make delivery in thirty d~ys':T
on orders.

Supt. narvel also recommended that a landscape contractor be
hired to straighten out large tree in the cemetery which
was blown over during the recent storm. Mayor Thayer agreed
to at'tend to this matter.
There being no further business to come before the
Council, Council adjourned.
