AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AMENDING CHAPTER 30, "ZONING"
OF THE CODE OF ORDINANCES OF THE CITY OF DELRAY
BEACH, FLORIDA~ BY AMENDING SECTION 30-17(O)(13), "GAS0-
LINE STATIONS", TO INCREASE THE ALLOWABLE CURB CUT
WIDTH FROM TWENTY-FOUR (2~) FEET TO THIRTY-FIVE (35)
FEET; PROVIDING A SAVING CLAUSE~ PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the Planning and Zoning Board at a meeting held February 23, 1982,
unanimously passed a motion recommending that City Council adopt an amendment to Section 30-
17(O)(13), "Gasoline Stations," to increase the allowable curb cut width from twenty-four (2#) feet to
thirty-five (35) feet to allow for better traffic circulation in and out of the facility.
NOW, THEREFORE~ BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section I. That Chapter 30, "Zoning," Section 30-17(O)(13), "Gasoline Stations," of the
Code of Ordinances of the City of Delray Beach, Florida, is hereby amended to read as follows:
03) Curb Cuts. There shall be no more than two (2) curb cuts to any abutting street,
with a minimum of twenty-five (25) feet separating each cut. Each curb cut shall
not have a width exceeding ~en~-f~-l~2a~-~thirty-five (35) feet, exclusive of
transitions. Curb cuts shall not be located closer than twenty-five (25) feet to the
right-of-way lines of intersecting streets, nor less than fifteen 05) feet from an
abutting property line or alley. Approval for all curb cuts shall be obtained from
the Florida Department of Transportation, or the Palm Beach County Engineering
Department, whichever-has iurisdiction over the street on which the proposed
station is to be located. On corner lots, corner protective devices of types and
sizes sufficient to prevent ingress and egress of vehicles shall be installed.
Section 2. That should any section or provision of this ordinance or any portion thereof,
any paragraph, sentence, or word be declared by a Court of competent iurisdiction to be invalid,
such decision shall not affect the validity of the remainder hereof as a whole or part thereof other
than the part declared to be invalid.
Section 3. That this ordinance shall become effective ten (10) days after passage on
second and final reading.
