The Council met in regular session at 8 P.M.
with all members of the City Cou"1ci1, and the t;ity
Attorn~y present.

Mr. Cons tans who was in the audience stated
he had been informed that the Era of block 116 and the
Wk of block 108 had never been zoned. He submitted
plans for a building he wishes to erect on his
property located in block 116. After much discussion,
it was the opinion of the Council that the 'intent
in zoning that property would be business zone. Mr.
Cons tans asked for permit to build. Councilman DeWitt
moved that the building inspector grant Mr. Constans
permit, provided the property is outside Fire Zone #1.
and providing it does not conflict with other fire
zone requirements. Mr. Waters seconded the motion
which carried unanimously on roll call.

The Seacrest Hotel applied for regular liquor
lice nse. Mr. Nowlin advised the Council they were
entitled to this type license, and if they would
submit written application for same together with
check for $750. the Council could then proceed on same.
Next James Priest asked the Council to review
a sketch of proposed home he wished to build on
N.E. 2nd Ave. and 3rd st. Inspector Croft was instructe~
to check the set_~backs -on this with iV.r. Priest, after
which ],:r. DeWitt moved that this matter be referred to
the Zoning Commission, with the usual fee. Motion was
duly seconded and on roll call carried unanimously. .
Mr. David McClintic of Youngstown Ohio, who
has had fifteen years experience as life guard, applied
for this position with the City. He submitted Y.M.C.A.
recommendation, and gave Mr. Max Rendon of Idora
Amusement Co., Youngstown as a reference. The Council
thanked Mr. McClintic and told him they would advise
him within the next few days of the ir decision.

A letter from the members of the Lions Club
pertaining to the use of city playground for athletic
fiftd with locker rooms, scout den, and canning center
together with sketch of same was presented. Attorney
Byrd discussed same with the council, after which
Attorney Nowlin was instructed to work out some
resolutions for the council on the above.

Letter from C. Y. BJ~d, together with copy of
letter from his client Jno. B. Reid of Delocean Co.
was read, requesting assurance from the Council that
the property would be zoned according to the mutual
agreement reached between the City Attorney and Mr. Reid'S
Attorney.and the City Council. fie also asked permission
to dredge on a 24 hour a day basis. Mr. Jacobs insisted
that if any blasting is done, small charges of dynamite
be used. Attorney Nowlin agreed to reply to this letter~

Next Mr. Byrd discussed with the Council the
proposed repairs to the bridge, adviSing them they
ought to begin planting royal palms now on Atlantic
Avenue.
The Mayor stated the next order of business
was to decide whether or not to rescind the action
of the Council in granting liquor license to Jno. Morey
by motion regularly made, seconded and unanimously
carried, . 1:he Olerk was il1Structed to deliver license
to Mr. Morey.
Councilman DeWitt submitted approval of the
War Dept. for the pipeline under the IntEacoastal
Waterway, and asked the city Attorney to examine same,
and if it is in order, to send it on to Smith &
Gillespie, Engineers.
At this time a discussion ensued regarding
licensing bus lines in the city. ~o provision is
made for such a license in the city ordinance. No
action ,;,as take n on this matter.
Letters from C. W.Garner, Chairman of
Zoning Commission recommending that special permit
requ~sts from Wm. Krause, Frederick Duggan, and
Addison Clark be denied were read. Mr. Jacohs
moved that the recommendation of the Zoning Commis-
sion be accepted. Mr. DeWitt seconded the motion
which carried unanimously on roll call. The clerk
was ordered to write' Mr. Garner, referring him to
letter sent him Vctober 8th from a group of business
men, and ask1ng him for further suggestions. Attorney
. Nowlin agreed to draw up a special zone ordinance for

Communication from C. Y. Byrd expressing
interest in creation of apartment and hote17zone for
the beach section was read and ordered filed.
Resolution showing excerpts from the County ,/
Commissioners minutes with reference to lands dedicated
by the county for public use was presented. Lands
dedicated to Uelray Beach were as follows:- Nt of
S\~of NEi of Nwi S€c. 17. Lots 1- 4 and 9 $0 12 inc.
block4Q. All of block 48.
Outstanding County oertificates on above land totalled
$ll6.20. Attorney Nowlin was instructed to check these
papers and report back to the Council.
Letter fr6m m, ~. Nowlin aSking if Mary Heisley
could regain title to block 48 which formerly was owned
by the Heisley family was read. By motion regularly
made, seconded and unanimously carried, application by
Miss Heisley was denied.

Letter requesting address of C. Barker was
read and ordered filed.
Letter from Southern Bell Telephone Co. re-
garding house # was read. There ,is no'ordinance re-
quiring house numbering at the present time. Attorney
Nowlin agreed to draft such an ordinance.
Letter from Inez Morgan protesting to trailer
park in south end of town was read. Clerk was ordered
to advise her the request for such a permit was denied.
A communication from the F.E.C. advising im-
provements to station will probably be made during
November, and the crossing on Atlantic Avenue will be
attended to some time during 1946.
A letter from the Seaboard Railway advising
lights will be installed out there as soon as materials
are available, was read and ordered filed.
Notice from Camp J:ilanding of discharge of
Roy C. Baker was presented and ordered filed.
Letter inquiring as- to leasing of uolf Course
was read. Clerk was told to advise party city is not
interested at this time.

\ A Lengthy letter from the G. T. Dusters, inc.
was tead in which they asked permission to lease some
land out near the Golf Course. Members wanted to
discuss this further before answering same. ~o action
taken.
A communication from E. C. J. McShane protesting
to liquor store facing eanal St. was read. ~ayor Thayer
agreed to answer same.

Councilman <facobs re commended tha t we spray
the city disposal grounds with D.D.T. The 'Clerk was
ordered to write Bill Dade" of the Niagara Sprayer and
Chemical Co. in Jax. for figures on this material.

Chief of ~olice urott recommended Lee application be
tabled. Other applications were held over for further
investigation before action is taken.
Councilman \Vhite reported the City Engineer
'NiIl be here the 22nd. tle sa id he had had complaints
regarding water standing on highway near the Baptist
Church. Clerk was ordered to write the state Road'Dept.
requesting when they were going to remedy this condition.

Mr. Jacobs advised he had contaoted party who
had built the old shuffleboard courts and had secured a
verbal bid of $175 per court for new courts. No action
was taken on this, as Mr. Waters wanted to check into
it further.
Application from C. B. Hearst for grocery store

The Clerk was instructed to t.enew"insurance
wi th Plaatridge Agency for the "Schoolboy Patrol"
for one year by motion regularly made, seconded and
unanimously carried.
, Attorney Nowlin advised the Clerk anyone
wishing free license from the City, must show a
certificate which sets forth their disability.
The Clerk was instructed to issue occupational
licenses ,to the following:-

The vity Attorney advised that electricians should have /
their permits renewed each year by the examining board ~
before securing license. Due to the war, in tl1e/past--/
years circumstances altered the case, and the city did
not require the examination or the renewal of permits
before issuing licenses. The Council agreed to try to
reorganize the ~lectrical tioard in the near future.
Bills #2680 - tf2707-2749 amounting to $10.794.91
having been approved by the Finance Committee, were
ordered paid.
