DELRAY BEACH, FLORIDA, 'AMENDING,, CHAPTER 30, "ZONING"
OF THE CODE OF ORDINANCES OF \THE CITY OF DELRAY
BEACH, FLORIDA, BY AMENDING SEC'~ION 30-17(Q), "SUPPLE:
MENTARY REGULATIONS", TO LIMIT THE MINIMUM SPACING
BETWEEN BUILDINGS REQUIREMENT TO RESIDENTIAL BUILD-
INGS ONLY, AND TO CLARIFY THE DEFINITION OF HEIGHT TO
READ THE SAME AS THAT STATED IN SECTION 30-1(12) "DEFINI-
TIONS''; PROVIDING A SAVING CLAUSE; PROVIDING AN EFFEC-
TIVE DATE.
WHEREAS, the Planning and Zoning Board at a meeting held ~anuary 26, 19~2, unani-
mously passed a motion recommending that City Council adopt an amendment to Section 30-17(Q),
"Supplementary Regulations," to limit the minimum spacing between buildings requirement to
residential buildings only, and to clarify the definition of height to read the same as that stated in
Section 30-1(12), "Definitions".
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DELRAY BEACH, FLORIDA, AS FOLLOWS:
Section 1. That Chapter 30, "Zoning," Section 30-17(Q), "Supplementary Regulations," of
the Code of Ordinances of the City of Delray 15each, Florida, is hereby amended to read as follows:
(Q) Minimum Spacing Between Residential Buildings
The minimum horizontal distance(s) between any two (2) residential buildings
(referred to as Building, A and Building B) shall vary according to the length and
height of such buildings: Such minimum distances shall be the distance required
under the following formula;

D = Required Minimum Horizontal Distance.
LA = Effective Length of Building A. The effective length of Building A is the
length of that portion of its wall, or walls, from which perpendicular lines
drawn in a horizontal plane will intersect any wall of Building B. Where
Building A has a curved or irregular surface, such surface shall be enclosed
within an imaginary rectangle having its side nearest to Building B parallel
with Building B, and all measurements shall be made from said imaginary
rectangle.
LB = Effective Length of Building B. The e~fective length of Building B is the
length of that portion of its wall, or walls, from which perpendicular lines
drawn in a horizontal plane will intersect any wall of Building A. Where
Building B has a curved or irregular surface, such surface shall be enclosed
within an imaginary rectangle having its side nearest to Building A parallel
with Building A, and all measurements shall be made to said imaginary
rectangle.
HA = Building Heights of Buildin~ A and Building B. The heights of Buildin~ A and
and Building B~ being the vertical distance from ~rade to the hi~hest finished roof
HB surface of a flat roof or to the mean level between eaves and ridge ~.0r ~abl%

estabJished~ the height of a building shall be measured from the mean
elevation of the finished lot grade at the front of the building. Height as
applied to a story implies the vertical distance from top to top of two (2)
successive finished floor surfaces~ provided the distance is not greater than
ten (10) feet.
Section 2. That should any section or provision of this ordinance or any portion thereof,
any paragraph, sentence, or word be declared by a Court of competent jurisdiction to be invalid,
such decision shall not affect the validity of the remainder hereof as a whole or part thereof other
than the part declared to be invalid.
seCtio~ 3. That this ordinance shall become effective ten (10) days after passage on
second and final reading.
